Help nurseries!!!!

Hi can someone let me know where I stand with this....

I sent my son to Asquith nurseries, his key worker who was lovely left after 3 weeks and I was not happy with the replacement key worker.

I was paying £62 a day and found I was not getting value for money, he only went to socialize with child his own age it was not because there was no one at home.

He was in the toddler group that on the day he went never had more then 6 child. So not much socializing!

On 1 occasion I went to pick him up and he was in with the babies all around 6 months, the final straw was when I went to pick him up and he was running a very high temperature and they had not give him any copol or didn't bother to ring me.

I pulled him out on the spot and told them he would not be returning then put it in writing the following week.

I pay a month up front, I pulled him out the 1st week of November so £180 they had for sessions he wouldn't be attention.

A few days ago I had a debt collection letter from them asking me for more money up to the 18th December. So as well as keeping £180 they now want an extra £182 to take me up to a months notice.

Does anyone know if they can enforce this debt?

The terms and conditions do say as follows but I was not going to keep my son somewhere I felt he was not getting the proper care.

****In the event of the parent/guardian giving notice of withdrawal of
the child and immediately withdrawing the said child there shall be
due to the nursery one calendar month’s fees in lieu of notice.
Failure by the parent/guardian to provide one calendar month’s
notice or any notice at all shall render the parent/guardian liable to
the nursery for one month’s fees****

    You agreed to the terms but if you pulled him out because you wernt getting what you were paying for then tell them to whistle. A debt collector has no more power than a lollypop lady on her holidays unless the nursery have been to court first.
