Gladstone Solicitors - AEJ Management

Hi Guys,

Looking for some help/advice. I have read the newbies thread but honestly, it's all a little confusing for me.

My mother parked in a disabled bay (she does have a badge) at a shopping centre, and simply forgot to display the badge. She got a Parking Charge and on my advice I told her to ignore it. (I had a charge a couple years ago and ignoring it did the trick for me)

Now I see ignoring the charge is not the correct method to go by. She got this letter through the post recently. They even spelt her surname wrong!

    Do not pay, do not ignore, do not state who was driving under any circumstances.

    I refer to your letter of [insert date], and earlier correspondence.

    Firstly, I have no intention of paying the money demanded by your client, and any court proceedings will be vigorously defended.

    Second, should it be your client's intention to start court proceedings, you must provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:

    Please also note that a failure and/or refusal to comply with the Practice Direction will result in an immediate referral to the Solicitors Regulation Authority for breach of the Principles contained in the SRA Handbook version 8, published on 1st October 2013.

    In the meantime, and in the absence of a letter before claim, you should place a note on your file to the effect that this charge is disputed and your firm is required to cease and desist all further contact with me.

    I trust that I have made myself clear, and I suggest that you take your client's further instructions.

    You could also send a copy as per advice on the above thread to the SRA complaining about Gladstone's apparent confusion over their representation of the client - ie. stating acting for parking company but requesting payment to debt collector.:D

    The computer generated letter is terrible in any case and an attempt to scaremonger people into paying up implying costs for judgments and warrants which even if it was taken to court and you lost - provided you paid in full these costs would not apply.
