Helkp! Claiming Tax Credits Back

Hi,

My wife and i split in November 2005 and my daughter stayed with me, I didn't tell the Tax Credit people (my fault entirly, was more worried about keeping the house etc), the tax credits were in her name. I have recently had to go part time due an illness, I am on the mend now, but still can't work full time. Part of my financial decision to go part time was increase in Tax Credits, I told them in March and they stopped the payments and I am still waiting for my claim to kick in, in the mean time they are threatening to take me to court for the "over payment" Nov 05 - Mar 07 of £750, but when the new claim starts I can only claim back 3 mths?? Is there a way I can Claim back longer? I have asked them and they said I can appeal, but won't win? My daughter didn't vanish in this time? Surely I am entitled to something?

    No, there's not a way you can claim back longer. You can appeal, but it is unlikely you will win, as the longest you can backdate a claim is 3 months.
