    I do not think that anyone has been taken to court for this, does anyone else know the answer.
    You never know how far you can go until you go too far.

    It boils down to what your AST/lease agreement says with respect to parking and management thereof.

    UKPC (different PPC) were taken to court last year by an owner/lessee regarding trespass. (The PPC trespasses on the land by applying a PCN). UKPC lost the case and had to pay damages.

    It might be worth digging out your lease.
    You may be owed some compensation if they conducting a commercial operation using your leasehold land.

    With the exception of a clause against parking/maintaining commercial vehicles, there's no explicit mention of parking (AST).

    That makes your situation pretty much the same as for the UKPC case I mentioned. :)
  • Getting around to sending my appeal letter today. I had waited for the management company to reply, who duly "confirmed" that UK CPM operate within parameters set out by themselves and CC'd in their contact at UK CPM for response.

    Nothing came of this, but who expected otherwise...

    I notice UK CPM don't appear on the FOI request responses to court papers issued between 2012-13...

    That's good but doesn't mean they wouldn't in future of course. KEEP ALL LETTERS FOR YEARS IN A FILE JUST IN CASE. Also get pics of the signs as they are now, in case they change them.

    Anyway, it's generally considered best to send a strong rebuttal appeal/complaint (whatever you call it) as you've left it too late to get a POPLA code I suspect. Doesn't mean you can't demand one though to make you look reasonable and them look bad if ever you were arguing the point in small claims! Write assertively stating why they have no cause to pursue this charge.

    Thanks, I've done just this. In terms of the DRP letter-chain, should I just expect continued letters along the same lines?
