    Hi MeggieMoo8, it may be your best bet to make a formal complaint to Erudio first, then complain to the Financial Ombudsman Service when Erudio refuse to do anything about it.

    Did Erudio remember to send you an arrears notice? Hopefully the decision above can help you with your complaint.
  • Good advice... I'd also add that it is well documented on here and in various news reports that Erudio have for the last two years messed up sending out their DAFs to many of it's 'customers', so they can hardly claim or guarantee anything was sent out to you. Their record would simply not back it up.

    Thanks for recent clarifications everyone!

    First point of interest from me is that my recent application for deferment of repayments was successful, which was a surprise. The "arrears" of £568 remain, this was not a surprise. #EDIT: see backdating offer below.#

    "Erudio" sent me an electronic DAF as part of a reply to some message I sent (when I gave an admin email address). The printout was not great because I was running out of ink, but it was readable except for their reference to their processing notice at their website. I filled in the relevant parts, left blanks, and wrote notes in a few places.

    At number 9, Certificate and Warranty, I crossed out half of (a), all of (c), half of (d), and all of (e). In the signature box (and under it) I wrote " I hereby confirm my application, my name is x, my family name is y."

    I crossed out some of the "processing notice", and hand wrote a declaration underneath, clearly stating that my application does not grant nor imply my consent to any new terms or conditions etcetera.

    Your correspondence is directed to Mark Filer. Please be advised that your loan was originally entered into with the Student Loans Company ... (paraphrase assignment trail) ... It is therefore entirely appropriate that we (rather than Mr Filer, as you appear to assert) respond to you on the issues that you have raised.

    I addressed some letters to "Mark Filer, Erudio Student Loans Company".

    I had asked who was legally responsible, noting that M Filer seemed to be the only employee. No volunteers for legally responsible individual, but corporations were partly invented for such reasons.

    "Erudio" wrote that they are unable to locate the letters dated 14 and 27 June 2016. These two letters were signed for at Wilmington Trust London, and Erudio Camberley (aka KGS Associates). They invite me to provide copies by email to (customerservices at erudio...).

    "Erudio" informed me that:
    "Ms Gatenby is an employee of the parent company which services Erudio Student Loans Limited";

    "Erudio Student Loans Limited contracts work out to other businesses. However, we are unable, and are not required to, provide any further details about the individuals who work for our contractors"

    (I don't remember asking for details of individuals... I did name the names of the signators for my recorded deliveries, and asked if KGS was FCA regulated.)

    "Capquest Debt Recovery Limited and Capquest Mortgage Services Limited are authorised and regulated by the Financial Conduct Authority for accounts formed under the Consumer Credit Act 1974 (amended 2006). Capquest Debt Recovery is also a member of the Credit Services Association."

    "Erudio" assure me that (they) take personal data security very seriously, and (they) conduct audits and checks on any suppliers [<ambiguous term within the grammar] (those suppliers) may use to ensure compliance with any regulations pertinent to (Erudio's) business.

    The small print at the foot of "Erudio's" letter page now states (after the usual Wilmington Trust Address) : Your account is administered by Arrow Global Limited ("AGL") for Erudio Student Loans Limited. AGL is part of the Arrow Global Group and is authorised and regulated by the Financial Conduct Authority" ... plus address, register number, company number.

    I haven't been to "Erudio's" website, so this is the first I heard from them about what you forum folks told me above.

    This response from Erudio does not reference my Subject Access Request, so I should get a list including KGS Associates from them, probably after the forty day shuffle, plus technicalities.

    Reading into "Erudio's" comments on arrears and deferment, after their usual 'requesting' and 'requiring', and explaining why arrears exist they wrote :

    "If you continue to refuse to complete and sign a DAF, the arrears on your account will not be removed and you will remain liable to make payments. However, as we have previously offered [# and had withdrawn #], if you now return a completed and signed DAF to us, and we are able to accept this as showing your eligibility for deferral, we will back date the start date of your deferment period to the date of your original request (28 November 2014) as a gesture of goodwill. This will remove the arrears from your account. We confirm that your completion and signature of the DAF does not change the terms and conditions that you signed up to when you entered into the agreements for your student loan."

    So although my deferment acceptance states that I still have arrears, this offer states arrears will be removed if my application is accepted. I don't know if there has been some lack of communication between departments, but I'll point them to each other if necessary.

    Note well, that changing original terms might not be thought the same as introducing new ones.

    Just had my annual statement arrive, which also is asking for monthly payments. Weird as I thought they had terminated my account and passed it on (not heard from any DCA), so why are they asking me for money? Do they want paying twice? Bought for 5p in the £1 you'd think they'd be happy with once.

    Also the PO BOX on the back of the envelope is for Hudderfield not the Erudio Camberley which is used in the letter. My previous Annual Statement had Erudio PO Box. A quick google brings up a post on here from 2012 and it's owned by the old FairFax. Just checked my previous letters and all arrears/termination/default letters are from there. Like one big happy family.

    It's an absolute joke that this is still going on. It's a shambles.

    Any update from Edwood Woodwoods county court claim from a few months ago?

    Also has anyone tried the Estoppel method? Might give it a go since nothing else has worked and the government don't give a damn.

    Well annual statement arrived .they are bloody incompetent. It's taken them 4 months to notice my standing order has not been paidone. Bank messed up. Now I'm in arrears !!!!!!. I'm fuming. I won't be able to deffer either as my benefits will take me over the threshold. Even though I've been overpaying.
    ONE HOUSE , DS+ DD Missymoo Living a day at a time and getting through this mess you have created.
    One day life will have no choice but to be nice to me :rotfl:
