I should be able to get it done this evening, so if anyone wants to ask BIS a specific question, let me know.0 -
I've just received the new DAF. I'm aware that some people don't want to fill one in at all.
But for me, I have decided it is an improvement on the previous DAF, and there is an envelope with it too.
I still put 'I don't accept any changes to the original terms and conditions' along with my signature on the DAF, because I don't trust them.
I've also sent them my DAF and SAF via email and cc'd the FOS in. I am then sending it by post. I'm taking these steps, because I don't trust them.
I hope it goes through a lot smoother, and with less stress than last year.
And I hope they keep holding out on marking my credit file with 'on holiday' (I have a pre-1998 contract).
So, lots of hoping overall.
Good luck everyone with your deferment regardless of the approach you take (ie. with/without DAF, altered DAF etc)0 -
Reading the above - is there a possibility that they ran a check on my spouse? What is an association and how are they created?
An association shows that you have a financial connection with someone else. This is created by joint judgments, joint accounts, joint credit applications, or from information you gave to us or to lenders. Associations are not created for business partners. The name of the person you have a financial connection with will appear on your credit report, but the financial information about them will not. Your credit report will only show information about you.
Lenders can see financial information about anyone you are financially connected to and may take account of this when you apply for credit. If you believe that somebody else's credit report caused a lender to refuse you credit, you may wish to ask that other person to request a copy of their own credit report. However, they do not have to do so nor do they have to show you their credit report.

So erudio HIDE the FPN on their Website instead of on their NEW DAF.
LOL
Yes, and the legality of doing that and just referring you to their website is dubious at best.
Insofar as, can you be held to having agreed to them if they are not in the document you sign and not in a durable or permanent medium.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

One particularly valuable post: someone has a partner who is a lawyer, and she provided a legal letter stating, in terms of the law, why they could not require things like a direct debit and the information requested on their DAF in order for him to defer the loan. The text of the letter is given in full, as is the result: they backed down and agreed to deferral.
Top tip, you can navigate straight to that page by hitting the little blue arrow beside the page number 181 and typing in the page you need:)
Its page 138 :-)0 -

Being forced to sign up to dynamic terms and conditions that are not in my interests will see me using a letter (again) and the courts (again) to enforce the original agreement."Love you Dave Brooker! x"

"In principle credit blacklists are tools intended to help assessing the risk of financial and commercial transactions. Therefore, they are instruments with a legitimate and useful objective, helping to safeguard the economy.
In practice the companies accessing the lists are using the “threat of inclusion” as a coercive instrument to force payments from people or companies. The worrying fact is that there is an increase of illicit inclusions of companies or individuals that in reality did not default any payment."
"Getting out of a credit blacklist
There are 3 possible ways:- Pay the debt
- Demonstrate that the debt is non existent
- Wait six years to be excluded from the list
Asking for damages
The erroneous inclusion in a credit blacklist or the failure to erase personal data when any of the conditions of the previous paragraph are met, is sufficient for claiming for damages to the creditor and to the company managing the list.
The court related to the domicile of the plaintiff will be competent. The process will be settled by ordinary judicial proceedings, whatever amount is claimed (art. 249.1.2 LEC)."

"A £400 million tax avoidance scheme devised by advisers who also created schemes used by Jimmy Carr and Chris Moyles has been shut down, according to The Times."
"The Highlands scheme hit the headlines last year when it was revealed that 305 investors used it to claim £391.8 million of tax relief.
It was shut down after a judge ruled that ‘it was a tax avoidance scheme with no underlying purpose whatsoever’."
"According to The Times the scheme was devised by NT (No Tax) Advisors and created by SG Hambro, the private bank owned by Soci!t! G!n!rale."
"The Times reported that SG Hambro set up and controlled the offshore companies involved in Highlands through a charitable trust and then created tax relief for investors by arranging a series of transactions involving dividend purchase."
"Treasury Minister David Guake told the paper: ‘These schemes are an affront to the vast majority of businesses and people who pay what they owe.’""Love you Dave Brooker! x"
