Has anyone here taken Erudio to a small claims court? I did a search today and it came up with a small claims court preliminary hearing against them already but couldn't see any further information on this apart from the case number and claimant. I would love to think that someone has - Good luck to them I say0

That bit about authorising them to contact the sources of our income was one issue I had. I very nearly didn't sign but dug out an old SLC deferment form and saw similar wording so assumed I didn't have an argument. The above posts suggest otherwise.
I did however include a note that I did not consent to any change in the the terms and conditions of the original loans.
I assume it's the same for all sources of income and not just employers (for those who are being supported by a partner (or relative)?
I wonder if it works in a similar way to tenancy agreements. In that statute overrides contract, i.e. a landlord might include an unreasonable clause in a tenancy agreement but it isn't enforceable (even if the lease is signed by the tenant)?

I believe lowering the threshold by over £2,000 is unfair and not realistic. It seems very coincidental that just when the old loans have 5 years left, all of a sudden the threshold is lowered and a 5-year repayment plan is enforced.
I have contacted Erudio about this as well and emailed their managing director ([EMAIL="stuart.lammin@carval.com"]stuart.lammin@carval.com[/EMAIL]) and have found his PA very efficient and friendly ([EMAIL="rkellett@arrowglobal.net"]rkellett@arrowglobal.net[/EMAIL]) when escalating issues.0 -

There is also the issue of trying to force people who have less than 5 years until the loans are written off to pay more each month (so the full amount is paid in less than 5 years, ie. before it is written off) rather than split the amount over 5 years.0 -
Surely the repayment period was always 60 months? I had a period when I was over the threshold and was paying, but that was quite some time ago and I was subsequently made redundant. I have no prospect of earning anything like the threshold amount at the moment and turn 60 in nine months time - before my current deferment ends. It will be interesting to see how the application to write off the loan goes.0

The repayment term should be 60 months. If I was you, I would contact Student Loans to ask what they would do if they still held your loan...0 -
I think for the moment I'm just going to let it lie. I was deferred ok by Erudio - some hassle, but nothing in comparison with that experienced by others here. My intention at present is to submit a request for the loan to be written off - probably around a month before my birthday.0

Quick update on me, and something significant from Erudio... sorry taken so long.
I got a NoSIA today - says 2 months in arrears, but it should say 4. The amount relates to 4, so dunno what thats all about. Their site says they will issue a default 31 days after the NoSIA so lets see what happens. Need to speak with FOS tomorrow, doubt they can advise much but will see if I can get any assurances.
I applied to defer by letter with statements etc by the way...
So - significant bit, direct quote from written correspondence between Erudio and FOS in regards to my complaint:
"Borrowers such as xxx are being offered the option to consent for their up to date accounts to be reported. If consent is withheld, these loans will not be reported to credit reference agencies unless they are in arrears or default"
"should xxx complete and sign the deferment application form, but indicate that he does not consent to the fair processing notice, then his deferment application will be processed in the usual manner"

Although I'm now wondering if "usual manner" means they'll put me thru as having consented!!0 -
By the way, does a formal complaint really freeze an account for 8 weeks?0
