Hi a mate of mine has just bought a TV from Curry's Online and decided after having it on the wall for just a day that he wished he'd gone for a different one again from Curry's online.
I've had a quick look at their t&c's and it says returns will only be accepted if it is unused and still in the original packaging.
I thought and have told him that he has 14days to returns product if unsuitable for whatever reason.
Can he return it or not?

Under DSR it should be possible but by putting it on the wall your friend may have went to far and so they will refuse for failing to take reasonable care of it.
They will refuse anyway as its out the packaging but even though they are supposed to let you return it under DSR they will fight you all the way.
Tell your friend to just tell them you opened the box to look at it as allowed by the DSR and decided it wasn't right for you and so wish to return it as is your legal rights.0 -
Under the DSRs you have 7 days (not 14) to inform them that you wish to cancel the contract - that doesn't mean the product has to be returned in that time, but you have to tell them you want to cancel. The product can be returned at a later date.
If you cancel a contract and are entitled to a refund under DSRs but you haven't taken proper care of the product (ie if you have used it/damaged it so it is no longer fit to be sold) you can still be liable for the cost of the item...so in effect the money is refunded with one hand and taken away with the other.Common sense?...There's nothing common about sense!0
