How can they claw back money when they are the ones that have ended the employment in the first place? Sounds like a scam to get back the money they paid out!0

All of this rests on what your contract says about contractual maternity pay so you definitely need to look at your contract.
I also agree that they should not be deducting this until the outcome of your appeal.
And one final point. If the worse comes to the worse and you are dismissed then they can only claim back the contractual maternity pay. (if the contract allows for this) They should deduct from it the statutory maternity pay.

Thanks I'll contact hr tomorrow find out what policy is and also email manager doing appeal and ask that they put the claw back on hold until after appeal :-/0

This may have nothing to do with the appeal manager unless it was s/he who has taken the decision to claw back. The decision will likely have been taken after advice from HR.Don’t be a can’t, be a can.0 -
I know a few companies that have this clause written in to contracts, the NHS being one of them.Life is like a box of chocolates..........you always seem to pick the hard ones!0
