Dismissed.... Company claiming back mat pay?

Hi,

I am looking for advice. I had my daughter in October 2012 and took 6 months may leave so returned in April 2013. I was paid enhanced mat pay. I was dismissed from my job in feb this year (long story and appeal pending) however the company have sent me my final pay slip which is -£700 odd! My boss advised me that they were claiming some mat pay back as I hadn't been back from mat leave for 12 months. Can anyone offer any advice on this? Tia

    Have you checked your contract of employment or the policy for enhanced mat pay?
  • No, I've asked for my contract as I don't have it due to starting there 8 years ago :-/
  • What you need is the maternity pay policy.

    Regardless, if you a went to appeal the company should call off the dogs re claw back of alleged overpayment until appeal process is exhausted.

    Perhaps they have already decided what the outcome of the appeal will be!

    They are a large organisation who probably informed payroll of dismissal that day, payroll will have no idea about appeal. Do you think this is right or should I email person doing appeal and ask why they have not stopped this until after appeal? The appeal should be within 10 days - I'm waiting over a month :-/

    I'd be looking to escalate to the next level in the appeal process is they have let their own timescales slip to this extent.

    Re payroll, perhaps e-mail your manager outlining your concern and cc in the payroll manager. Payroll are unlikey to act directly to your requests.

    Just to check - are you sure the APPEAL should be held within 10 days, rather than management having to respond to your appeal within 10 days? (10 days seems v short to me, and could disadvantage you as it would mean any union representation had to respond very fast.)
    Ex board guide. Signature now changed (if you know, you know).
  • Hi it says on their policy appeals are normally heard within 10 working days, it's been more than that and been given a date of 27th march. I sent appeal on 25th feb :-(

    "Normally" isn't "always".
