Splitting up with long term partner mortgage assistance

Evening all,

I have been with my partner for the past four years and have a 1 year old child with my partner.

I live in his property which he has mortgaged by him and his ex partner. However I pay most of the bills from my account and have contributed towards mortgage.

We are possibly on the verge of splitting up and wondered if anybody knew where I would stand with regards to his property. I dont want to take him to the cleaners but feel I should be entitled to something due to contributing towards the upkeep of that house for the past 4 years.

    More to the point: will he be paying maintenance towards his child?

    You've lived in a property owned by him for four years ....hardly a long-term relationship. You would have had to pay rental/housing costs on your own during that period - did you pay for any improvements or betterments during that period?

    If you aren't on the land registry or the deeds, the only way you can enforce a share of the property if he doesn't want to give you one is by expensive and difficult legal action.

    You have very little chance to get anything, and even if you did, I expect the minimum share of equity you could claim for i.e no more than 1/4 for the 4 years is unlikely to be more than what you would have to spent on a solicitor to plead your case. You made a mistake by agreeing to pay towards the mortgage, but wasn't really the arrangement? Or was it a case of paying x amount of money to pay towards the bills and an element of rent?

    Unless you paid money directly into the mortgage account or directly towards the cost of home improvements his solicitor will argue that the money you have contributed will be for normal living costs of your share of the utilities and rent to your partner and his ex to live in their house.

    If you can prove that you paid half the mortgage since you moved in 4 years ago, you'd be entitled to half the equity increase since you moved in.

    house prices in many areas haven't risen in 4 years. In fact, if they property was worth less, you could owe him money!

    Do your maths before demanding money.

    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    No you couldn't! That's just not how the law works with property and unmarried couples.
