  • Thank you for that info there... just paid for the registry doc and it says lender then the bank name...does this mean that there is still a mortgage on it? or could it just be that it hasn't been updated? Probably irrelevant but Im just being nosey LOL
    I am hoping that he will ask us to leave early...that would be brilliant! The worst part is that when he was ranting and raving on the phone he said and I quote 'if you want to leave then leave' so we asked if that offer still stood. The response was a phone call from LA saying that he would make a decision after inspecting the property, he never showed up for the inspection so the LA did it on their own. Due to me saying that I would be taking everything with me (carpets etc that we have paid for ) he said no! I have all of his stuff in storage so I shall put it all back in place before we leave.
    In the mean time I do want the repairs done. The damp next to my bed is green with some salt growing through and it smells !
    All help/advice is very much appreciated

    Call CAB and shelter and environmental health at local council.
    Letter to lender on land registry just to inform them that you are renting the property with copy of tenancy agreement and asking has Landlord ( owner) got permission to let ( either consent to let or BTL mortgage ).
    This makes it difficult for lender to evict you as you have a valid tenancy for 6 months remaining.
    It also drops LL in the poo if he is on the fiddle.
    Letter to HMRC ?

    Send a signed for AND a standard letter. Get certificate of postage for the unsigned one.

    Speak to local council .. They should have a private landlord team.
  • I was just thinking about the land registry...Their current address is different to the one I rent so I am assuming that the lender knows?(lender put a charge on in 2012 but they have owned the property since 1983 ).
    I spoke briefly to the private lettings during the week and they said that they will write to the LA re repairs.
    If he would just let us go it would make both our lives easier ! I hate paying him £1000 a month as it is just pocket money to him yet he wont do repairs! (his parents own the house and are the LL but he deals with everything )

    Legally the LA have to supply you with the LL's name and address so write to them (pen & paper) and ask for these details. Then write directly to your LL asking for repairs and if he won't do the repairs follow the process on Shelter's website.

    Make sure that all your correspondence is now done by good old fashioned pen and paper.

    I know how galling to pay out so much money to rent a property when the LL couldn't give a fig about repairs. You just need to play the game. It might be worth checking other details such as whether or not there is a valid gas safety certificate and that your deposit has been protected if you really want to be a pain in his !!!!. :D
  • thank you. Yes I am going to write directly to the LL at the address on the land registry doc starting from step 1 of the shelter guidlines.
    I was present when gas engineer did the cert so thats all above board.
    I have also checked my deposit. paid in cash in aug not registered til 1st nov and no PI has been issued( LA/LL dont know that I know this yet ;-) )
    It's very frustrating....
  • Definitely involve Environmental Health and get them to do an HHSRS (Housing Health & Safety Rating System) check on the property - sounds like it will fail on several counts and they'll serve a Notice of Improvement on the LL. I appreciate that you're keen to just get away ASAP but the LL will just re-let to someone else and they'll have the same problems if the work isn't done. If he doesn't do the work then, ultimately, the council can confiscate the property.

    As someone else said, the agent is legally required to provide you with the LL's contact details on request, unless he lives overseas.

    Keep a record of all communication with the agent AND the landlord, so you can show that you have been reasonable in your requests.
