sorry for the late reply.
they did not provide an agreement or receipts, I paid by debit card and got a note for the excess on the hire report 'IN' part.
they accept that they did not have insurance on their hire vehicle. How did they drive it themselves?
i got jugment but they have now applied to set this aside as they say I agreed to use my own insurance and paid the excess for the damage rather than make a claim against myself (this is untrue).
