GPEOL and Holidays

I have just been listening to a feature on BBC 4's Monybox programme where somebody took Thomson Holidays to court after they demanded a 100% cancellation fee after he had to cancel his holiday because his wife was taken ill a week before they were due to travel.
He argued that the company had not lost all that money because it appears that they had re-sold the holiday. The judge agreed with him, and ruled that the 100% cancellation did not represent the actual loss suffered by the holiday company.
Glad to see yet another judge who seems to know the ins and outs of GPEOL . Lets hope he also has some PPC cases up before him.

Had TUI not been so hard nosed they would not have landed themselves in this mess. All the claimant wanted was a refund of the £150 which he paid out for taxis.
