ParkingEye court summons

When I originally got the fine I trawled through numerous forums telling me to ignore the letters Bargepole, and with a young baby I simply did not have a few hours spare to read the information.0
-
It's not a "FINE"!What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
-
when you got the parking charge invoice (what you call a fine and yet it wont have the word FINE anywhere on it as its a legal term and they are banned from using it) then clearly you did not read this sticky thread here
https://forums.moneysavingexpert.com/discussion/4816822
if you had appealed it and gone to popla you would not be in this serious situation you are in now which is being taken to small claims court, that would have taken a lot less personal time than this court case will take
so now its at the court stage, ignoring will result in default judgement and if you do not pay a CCJ will be given out a month later
its now time to deal with it and these are the 2 links you need but still havent read
https://forums.moneysavingexpert.com/discussion/4754020
http://parking-prankster.com/guide-version.html
my advice is stop typing and go read them, also stop using the legal words FINE and SUMMONS as they are not relevant and this is about legal matters and court where its important to use the correct words (those 2 words wont appear on any of your paperwork so far)0 -
This is probably a mcol claim, so you can deal with this online. Go to the money claim online website, so acknowledge the claim say that you are going to defend in full, ask for 28 days to form your defence. Unless of course you wish to pay the invoice.
There is lots to help you with this, google parking prankster and look at his ebooks on this, one is free the other costs a few quid, both will help you do a defence on this claim. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

If you don't make the time to read, understand and then act on the information provided in the links then you will lose the case and have to pay, which if you continue to bury your head in the sand and ignore the court could mean you ending up with a CCJ to boot..
Can you really not afford the time to save you this money? Ultimately its your choice.Originally Posted by shortcrust

What you have to remember is anyone can sue you at any time for anything and this lot have decided to sue you because you own a car and they think you should pay them money they have not lost.
It will not go away, whatever else you have on your plate is now very firmly on the back burner until this is dealt with.
Firstly What is the plaintiff, who is taking you to county court.Be happy...;)0 -
There are lots of folks on here - willing and able to help you beat this - but you have to read a bit more and do what is advised, as it is only with a correctly worded legal challenge that you will get this off your back. The correct words are very important.
However if you don't have / want to take the time needed to save yourself a few hundred pounds and the possible repercussions then it's perhaps better that you just pay up now.
If you insist on calling what you have received a fine, and that you read advice saying to ignore ( which stopped being correct well over a year ago) then you are going to lose.
You MUST check the date of any advice given. Even for buying a pair of shoes or a washing machine. Old advice is worse than no advice0 -

...and you read really old advice. Why not read the first page of any forum, not Google and read stuff from 2012? Madness.
You have been given the links you needs which tell you all about PE small claims and how to defend them. In the NEWBIES thread alone I linked a whole load of information for people like you, in a section called 'small claims'. And lots of people have won or made a lower offer, or got it cancelled by complaining to the retailer.
If you were pregnant (or delayed by taking time to breastfeed the baby) when you were accused of an 'overstay' then it's a breach of the Equality Act for a start.
This is not the end of the World to defend a small claim (it's not a flippin summons!) and to consider paying the full amount IMHO would be STUPID unless someone has more money than sense. So many options open to you, tons of info linked for you, please read then it first then ask more questions. We want to help you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have purchased the e-book by parking prankster which has made things so much clearer and I don't feel as scared now.
But when I first filled out the acknowledgment of service form I ticked the box saying I intend to contest the jurisdiction. It looks like that was a mistake, does anyone know if you can change it?0 -
I don't think you can change it, but you could just say that it was clicked in error in an email to the courts - if allowed - , or to submit it in your defence. Unless someone says any different? When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
