Unauthorised charge ?

I recently made a channel ferry crossing using a day return ticket on Brittany Ferries. When we got to France we decided to stay longer, and did not use the return ticket, only to find out later that my credit card had been relieved of another £52. Brittany ferries claimed that this was improper use of the day ticket, and we were charged the full fare.
Is this an unauthorised payment, as it was without my consent or knowledge?

If you check the T&C's you'll probably find it is right. It certainly is standard on Condor - The day return tickets are far cheaper than standard singles, and it is to stop them being 'abused'.

Have you now been charged what the day-return ticket should have cost in first place? If you have then I dont really see how you can have any complaints?

Yes it is in the T& Cs, but I don't think they should be able to dip into my credit card as they feel free to do so.
It also says that 'once a payment has been made, no further charge will be applied' !

But you agreed they could when you booked...
ADDITIONAL CONDITIONS RELATING TO PROMOTIONAL FARES (INCLUDING SPANISH MINI CRUISES & 24 HOUR RETURNS)

Please note that special conditions apply to this promotional offer return crossing. Full payment is required at the time of booking by credit or debit card for all special offer fares. These fares are subject to restricted durations and are only valid providing both the outward and return journeys completed as specified on the ticket. Where they are not the outward journey will be considered a ‘single’ journey and it will be repriced at the single tariff. Any additional payment will be collected from the credit/debit card used for the original payment...

Yes, by default, and I know we should read the T & C's.....but I don't think they should be able to, specially where there are mitigating circumstances such as illness.
Can the County Court ask them to change this condition, I wonder ?

You should have travel insurance to cope with the extra costs incurred as a result of illness.

At the end of the day if you don't like the way they operate their business then either find another operator, an alternative way to travel, don't go or start your own business.

Personally I think it would be more "moral" if they told you at the time that your choices were to "pay up" the extra or to not allow you to travel, however that may not be practical in the business that they run e.g. might create huge queues.

I don't think any court in the land would touch your case!
