PCM (UK) Chicken Out of Court Case

I was contacted by an OP who had lost a POPLA appeal (she pleaded mitigation), and then had been taken to Court by PCM.

At the original hearing in December, the Judge had adjourned the case for PCM to provide time-stamped photos of the alleged offence, but had commented that she didn't think she could go against POPLA.

I took this one up, and submitted a new Skeleton Argument for the defendant, in which I explained the non-statutory nature of the BPA Ltd. and POPLA, as well as the usual arguments - no contract, no standing, no GPEOL.

This was all set to go back to court next week, and I was going to represent the defendant, but now she's had a letter from PCM to say that it's not worth the costs, or the time, for them to attend, so the claim is discontinued.

The OP has phoned the Court, and they have confirmed they've received the letter, and it's all cancelled.

    ACPOA have now done the same:-

    After having submitted a bundle of documentation to the Court and sent copies to the other side, and less than two weeks prior to the date of the hearing, I've had notice from APCOA's solicitor that my case has been discontinued.

    Many thanks to the forum members who've assisted me – it's all been very much appreciated.
