how sick can you be on class 2 contirbutions

Hi Hubby has has been suffering with bad joints for months, test now reveal he has very bad arthirits. Original tests showed this but we were misinformed!! He is a builder and mainly a roofer, he has not been able to go up ladders for some time due to pain. Doctor has given him a two week sick note, forms for more tests and the long term diagnose of sort your life out as it won't get any better. Trouble is although he is up to date with IR and the Nic 1 you pay with self assesments, but not with Class 2 He has been self employed for about 7 years. and it's always been one of those get round to things. He currently has several really good contracts going on, which if he can see through would clear most of our debts, but obviously he is having trouble working, the lads he is currently using now do leg work but he still has to oversee, pick up stuff arrange payments order etc, which he has been finding hard due partly cause he is too dam tired to work and awake at nights through pain. He is worried if he carries on working but not claiming sick the benifits people will not allow him to claim when contracts are finish, also can he claim due to Class 2 not being up to date. He was going to go to benifits office and talk to them but I really would like some imput of you all first.

    If he has not paid his class 2 National Insurance in recent years he will not get any Incapacity Benefit. They have to be paid by law so sooner or later the tax office will be chasing him for payments.

    these are the volunatary ones that are about £2 per week arn't they can he pay a lump sum to bring up to date, he has never been chased for them, which has suprised me. as I say the other ni that he pays as a percentage of his self assesment is up to date, what exactly does each nat insurance do,

    In order to claim pure incapacity benefit he would have to have paid enough class 2 contributions in the last two tax years. He could possibly claim incap with income support, he could claim for you as well. This is a means tested benefit and will look at all income coming into the house. If you work over 24 hrs he wont be able to claim this. If you work under 24 hrs they will let you keep the first 10 pounds then it comes off your benefit pound for pound. They will look at savings of over 2.500 pounds and if you have 8 thousand or more you cant claim. If you do work over 24 hrs all he would be able to claim is his national insurance credits for incapacity benefit.

    You might find putting in a claim for Disablity Living Allowance worthwhile you can get the number or forms from your local jobcentre. Also if he does decide to claim incap he will get to see a specialist adviser at the jobcentre and should he decide eventually to go back to a different job he will receive all sorts of help and financial incentives to achieve this. Its called pathways to work. Also if on DLA once back at work he could claim disablity tax credits.

    You will need to ring the inland revenue about his class 2 stamps i am really suprised he has not been chased for them. You need to ring your nearest jobcentre and get some advice from them, or ask them to give you the benefit helpline its an 0800 number and they are there for people specifically with health conditions.

    hi don't think we could claim for me I work, and have a fairly well paid job I work between 12 to 20 hours a week. Kids are all grown up, no mortgage but a reasonable monthly income from another source Can he pay his class two up to date. Like I say class four and NIc up to date
    Also as he has only had sick note at moment what could he claim for, and as his illness gets worse what benefits can he get then

    Class 2 isn't voluntary , its the compulsory (unless you have exemption) NI contributions for the S/Employed . Class 4 is effectively an earnings tax.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    The capital limits changed in April 2006.The lower capital limit is now £6000.The upper capital limit is £16000.

    Why do self employed people pay less NI than employed people? Do they get less benefits? Not getting at anyone, just interested.

    They cannot claim contribution based JSA.
