Ukcps 2nd letter

Hi all,
In early January I got a windscreen fine from ukcps. Searching through the forums I decided to ignore it until I received their first letter. It never came, now I have received a letter which says 28 days has now past since we last wrote to you and I have lost my right as registered keeper to name the driver etc etc.
Not really sure what to do from here. Having not received the first letter I thought I had got lucky and fell of their radar. Should I just treat this as if it was the first letter and start from the first letter appealing the Ppc?

You need to start by reading the NEWBIES sticky thread. It gives you all the information you need to beat this scam. Meanwhile, the more experienced posters will need you to provide some info such as where this took place, England and Wales or Scotland or Norn Iron, retail park/supermarket etcetera. Scan anything you have received and load it into something like photobucket or tinypic so you can post it on here when requested.
Go back to where the incident took place if possible and take pictures of all signage. Get them ready to post on here as well.
The main thing is, do not pay, do not ignore, do not name the driver, keep calm and have a brew.
Did I mention that you MUST read the Newbies thread before coming back here. You can beat this with help from here but you are expected to do a lot of the legwork yourself.

Ok further reading through the forums indicate that not receiving the first letter is not a defence. However stating that the first letter hasn't been delivered is something to mention in my initial appeal. I'm going to slightly edit the appeal in the newbies thread which I will post up here before sending.
More background information. I was the driver but my girlfriend is the registered keeper and the letters are addressed to her. The incident took place in England. The offence was parking out of marked bay in early January which I did do out of sheer desperation. The car park services an entertainment area in Sheffield called centertainment, which hosts a cinema, bowling alley and a number of restaurants. My girlfriend and I subscribe to the cinema there for £15 a month. We also eat fairly often there as we can get discounts from most of the food joints. However it's also across the road from the Sheffield arena which creates a problem. The arena car park charges for staying there during event. It's the go to place for any big shows coming to Sheffield, bands, comedians bloody dancing on ice.
So obviously the people going to these shows use the centertainment car park to avoid paying for a stay at the arena. Which there not meant to do. 5 times now we've gone to the cinema only to drive around the car park for half an hour before going home/somewhere else. However at the time of the incident the other half had gotten out to meet up with friends and sort the tickets as we'd arranged a catch up.
So out of frustration and desperation I broke and did what many had already done and always do. I parked out of a bay. There must be 50+ that do this every weekend night when the arena has something on.
Ukcps must love this. They charge those they deem to have parked there to go over to the arena and those that park out of bay because of it!
I obviously came out to the ticket on my window. After a google search I decided to wait till there 1st letter had arrived. Thought I'd gotten lucky when one didn't but now I have the 2nd letter.
So my action plan is. Talk to cineworld management in person and explain the problem and our annoyance at paying a subscription for service we aren't free to enjoy. Letters to a few of the restaurants to the same effect. And my first appeal to ukcps. Also I will check out signage on site but even though I've never spotted any I'm sure there will be some.0 -
In fact other than popping in a part to request a popla reference I don't see any legit reason to edit the appeal at all. This letter being my first correspondence won't help much?0

They should then contact you with an invitation to pay.0 -
Yes I agree with guy, their guff of being to late to name the driver is garbage.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

But reading the forum I'm lead to believe not admitting a driver name is standard and that for windscreen invoices the clock cannot be reset. Also the keeper has more ability to fight it. So we decided not to contest the driver part. Or have I missed something?0 -

So you just send the appeal from the NEWBIES thread anyway. There's another UKCPS thread on here I saw yesterday where they appealed to the same letter you have, and got a POPLA code. They also had no first letter...very odd?!
I would not name the driver yet, why would she when the appeal may get a POPLA code, this is very early in the process. Try the appeal as normal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The other advice about not naming the driver applies when the keeper hasn't missed the boat.
Or you could take the chance and do as c-m suggests, although I can se no real benefit in not naming driver at your stage.0 -

Nope because it was a windscreen ticket at first. So the OP should treat the latest letter as a non-compliant NTK as it's the first letter received. It changes nothing about the advice to appeal, in the NEWBIES thread, just because UKCPS have sent the wrong letter or missed one out.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Don't doubt you are right, but let's see how this pans out. Your knowledge of the right way to do things exceeds UKCPS and wouldn't be surprised if they stuck to their original stance. But they might continue to claim NtK was sent and keeper failed to respond. Lost in post syndrome.0
