Just an update, the DC wrote back saying I must make payment by the end of the week, I guess I will keep ignoring right?0

Yep, DC letters are laughable but pointless. We've all ignored them for years before POPLA existed!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok so I just received a letter from the PCN again, and they have reduced the amount and said to pay immediately or they will bring this matter to court.
I don't plan on paying but does anyone have an idea on what to do now?
I did say in my letter to them that I would complain to their respective ATA regarding their arbitrary windows. I didn;t receive a POPLA code in this case since the appeal letter to them was out of their time frame.
Please help.0 -
Hi Cola109,
I think post #8 in this thread by Coupon-mad (quoted below) already covers the current situation and your questionsCoupon-mad wrote: »You are worried whether you 'stand a chance' yet the position you are in is simply the same as everyone was, who happily ignored fake PCNs before POPLA started in 2012. So not quite sure why everyone worries so much just because they missed the obvious winner - POPLA.
So do you stand a chance of getting a POPLA code? = probably not, as the appeal was late.
Will you get a rejection letter and more DRP and Zenith letters = Yes.
Do they mean anything? = No.
What are your rights = Well, a firm has sent a stupid invoice and you are not paying it. So what?! Good for you, they didn't earn it, there's been no loss!
What do you do about them as you've already said 'get stuffed' = Nothing. Keep all letters & photos though.
What to do if you get a Letter before Claim from UKPPO themselves = see the LBCCC Fightback thread (acknowledge and formally respond).
How likely is it? = Highly unlikely.
Do you stand a chance if it goes to small claims? = Yes.
Is it worth complaining when it's a residential car park = probably not.
Is it worth paying £160 now? Nope (a Court loss would be less, the PCN sum plus fee).
Do you get a CCJ if you lose in small claims? = Nope. Not if you then paid.
What to do if you get small claim papers from Northampton = defend with our help.
Anything else to do now? = Get photos of the signage as it stands, now. At the entrance and within the site, at the bays (in the dark if it was evening).
I have ignored & laughed at 4 fake PCNs myself and others on here have collected more. All that's happened is the keeper has thrown away the slam dunk EASY appeal stage (POPLA, unless they strike lucky in the reply!) and if it does go to small claims that's more of a lottery - but we've got MUCH better at defences recently!
They should simply ignore anything else from the debt collector but keep all the letters for years, just in case. That's what we always used to do; nothing happened except junk mail. Relax. Most cases never go beyond the flurry of regular multi-coloured junk mail.0 -
OK thanks guys.
Also I received a letter from the DC even though I wrote to them previously saying that if they continue to write to me, I would consider it harassment and complain. Do you think it's worth while me complaining and if so, who would that complaint go to?0 -
Well it's DRP and Zenith who send these letters and they are (to my knowledge, but Google it) no longer members of the Credit Services Association so they have no trade body Code of Practice to adhere to.
You could report this scam to your MP and the local Trading Standards.
OR you could ignore the whole letter chain as people did for years before POPLA existed. Keep all the drivel just in case the cowboy PPC ever try a small claim within 6 years (highly unlikely with UK Parking Patrol Office, can't recall any cases by them ever, and very defendable if it happened, and you've kept the evidence letters).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok guys thanks again0

Hello,
Just an update, I have just received a letter from 'Small Claims Solicitors' of 24 Martin Lane London. I will continue to ignore their letters, as from the other posts I've read, a letter from them is not considered an LBCCC.
Your thoughts or advice would be most appreciated.
Thanks0 -
Small Claims Solicitors are part of LPC Law. But they're acting in the context of debt collectors in your case, not solicitors.
So please do a search of the forum via the search engine using "Small Claims Solicitors" as the search term and you will see a number of previous references with advice pertaining to these. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I think you will find better forum results on pepipoo and here, by using Google to search:
'Small Claims Solicitors parking' {and you could add the name of your PPC}
...seeing as the words are too generic for our forum search facility. Google gives you examples of people who have had the same letter and ignored it as it's just another debt collector letter, not a real LBCCC. Firms who don't sue people (like UKPC) typically use that letter chain of drivel!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
