The Board has not questioned the lead adjudicator’s view on genuine pre estimate of loss. The issue has generated a great deal of heated debate and a number of legal arguments have been put forward on different sides of that debate. The board is of the view that these issues can only really be settled in the courts but that would require a court case, which may or may not materialise in the near future. An alternative would be to procure an expert opinion from a retired High Court judge which will be the best alternative to a court decision. The lead adjudicator has indicated that he would follow such an opinion unless a different decision subsequently arose in the courts.
The Independent Scrutiny Board does not currently have a budget for taking legal advice so it is seeking financing to obtain this opinion. If and when finance is available we will contract with solicitors to draw up a brief for the judge who we decide to approach.
The board has received a wide range of representations on this subject both from individuals, consumer groups, and operators . It is the level and diverse nature of the representations which prompted the board to respond at its first board meeting.

            To be fair - if their members acted in a fair and honest manner, and not out of total deception and greed, their job would be easier.
 If I'd been sent a letter saying that I'd outstayed my welcome for which there was a nominal charge (admin' etc) - I don't know - say £10 or £20 - there'd have been a cheque in the return post. However - trying to charge me £100 for not causing any damage to a car park that was 'free' for the first 60 minutes got my back up and encouraged me to fight.
 Similarly, if there were clear and obvious signage in the car park, I'd have selected reverse and found another place to park (I did walk the car park looking for a ticket meter such was my honesty in expecting to pay for a parking place) - OR I'd have set my alarm on my watch to ensure I was out of the car park in the allotted time.
 But then I get the feeling that these parking 'Operators' aren't in the game of being reasonable or fair........0
