Stamp duty

I bought a house 42 days ago and I haven't been asked by my solicitor to pay the £1650 stamp duty. Should I contact them or keep quiet !?

  • It's your liability so I'd be contacting them. Even if they've forgotten I very much doubt hmrc have so I don't think you're going to get away with it if that's what you're thinking.

    This is interesting because I have never bought a property when the solicitor has not asked for the stamp duty money at the time of completion.

    Did you use a conveyancing firm or a solicitor, are you sure stamp duty is payable, the property is not in a deprived area with stamp duty exemption is it?

    Disadvantaged area status ended last April, so it's not that.

    Did you buy with a mortgage? If you did, the solicitor should have collected the SDLT from you in advance of completion.

    If no mortgage, you have upto 30 days to pay the SDLT after completion. Did you pay for the solicitor to complete the SDLT return, or did you opt to do it yourself?

    If the latter, you may have accepted responsibility for the form and the payment.

    Ask your solicitor.

    Thanks for the replies.


    Its with a mortgage, which was done through a broker.


    I definitely haven't paid stamp duty, and the house was £165,000 so I owe £1,650. Its not in a deprived area. It was rushed through pretty quickly in the last week and the solicitor who I dealt with all the way though was actually on holiday the week of completion.


    I'm not aware that I had to pay the solicitor to complete the SDLT return, this was never mentioned.


    I would've thought it would've been asked for by now !

    Then the Solicitor is probably expecting you to complete the return.

    Did you ask them to keep their costs down?

    check your quotation from the solicitor - what did it include?

    I would chase up the solicitor about it, far better than facing a criminal charge for Fraud (failing to disclose).
