Won esa appeal dec but no change yet?

any1 help me ? here goes


I lost my ESA benefit in Oct 12, was placed onto income support due to having 2 children under age 3. I decided to appeal against decision. I was kept on income support and not asked for any more sick notes from then on.


In Dec 2013 I passed my tribunal and was told id be changed back onto ESA and backdated my due.


However, since then I've had no change, I recently rang and cancelled my Income support claim and ESA said they will open my claim back up now (Tuesday)


I've had no letters or any information about what I am entitled to, or any mention of the 16 or so months back date.


Has this happened to anyone else? will I be informed of back date and how long should it take to start receiving ESA again as im no longer in receipt of income support anymore?


any help appreciated x

    It took the DSS one calendar month after the tribunal to pay me the money they owed me. I don't remember receiving any info on the back benefit but I think that I must of. It was paid in a lump sum into my bank account like the regular ESA/Income Support benefit.

    I believe that you should of needed sick notes while you were waiting for your tribunal. That might be something to look into because it could of affected your claim.

    When you speak to them keep mentioning every time you speak to someone that you have 2 young children and that you are no longer receiving any benefit and have no income!

    https://www.gov.uk/government/publications/compensation-for-poor-service-a-guide-for-dwp-staff I refer you to.

    Ring ESA, and request a callback from a decision-maker.
    They should with luck be able to get your case moving - hopefully.
    Otherwise, it's probably a good idea to reopen the IS claim.
