Please give me advice, UK CPS parking notice

Hi, I went out to dinner and what happened is we parked in what we thought was the normal bay right next to the disabled ones, as it had one normal white line and only one side of yellow crosses unlike the rest of the disabled bays that had both sides yellow crossed. There was no sign infront of the bay and hardly any signs at all and it was dark. It was pretty confusing we double checked and thought it'd be okay, we would never deliberately park in a disabled bay. Well, obviously we came out, went home and found the sticker on the window by UKCPS.
I have read SOO much information and so many threads that I am pretty confused but what I gather is, I complain to the restaurant, then wait for the notice to keeper to send a letter (soft appeal?) to UKCPS whilst not stating driver. I have found a standard letter which I hope to modify to my personal circumstances but after that the whole Popla situation confuses me and I need to read more into the next stage. Can anyone give me any extra advice and comment if this letter is suitable? What could I include to make it a little more personal?

Dear UKCPS,
As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:
1) this charge is not a genuine pre-estimate of loss
2) your signage does not comply with the BPA Code of Practice
3) you do not have the authority or permission to issue invoices at this location
These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.

Only after receipt of NtK - no contact with UKCPS until then.
That initial (soft) appeal is fine. It will flag up that you've done some homework on this and you will be getting forum assistance with your POPLA appeal in due course if a cancellation isn't forthcoming. You will win at POPLA with our help.
No need to adapt the letter to 'your circumstances', not necessary - mitigation just doesn't cut any ice with PPCs or POPLA.
Don't worry at this stage about POPLA appeals, you have a good bit of time to do some more reading before your NtK, your soft appeal and response to it arrive. Things will become clearer as you read more - it can be confusing initially with what seems like information overload, but we're always here to help if some points are still not clear.
Well done on doing your initial research in getting to grips with this first stage of the process.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I think the hardest thing for first timers to accept is that there is nobody at the other end with any interest in reading these complaints. It is not just mitigation that doesn't work on a first appeal, neither does a watertight legal argument. You could write saying you were the land owner and point to the paragraph in your contract and the whitelist entry that you had given together with TV footage that you were receiving a knighthood from the queen on the day in question and they would still reject your appeal.0 -

Please, use the longer version of the first appeal that is in the NEWBIES sticky thread, which was written to flush out whether the charge is a contractual fee or not. UKCPS use various types of signage and you need to use a stronger appeal when you get the NTK. The info was at the top of the forum all along and you didn't have to hunt out a shorter appeal...please use the longer one in the sticky as it was designed with UKPCS in mind, among others.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
