Newlyn Court Action Pending

Hi all,

I am a newbie and have searched hi and lo and have not been able to find info on the specific situation I find myself in.

I apologise if I have broken protcol for the site or somehow come across as ill mannered. Ignorance is my only crime.

However, I am in a slight panic. I realise I should have appealed but was misinformed that ignoring was the thing to do. On searching the internet more thouroughly I recognise my mistake.

I received a PCN via a letter, on 9/7/2013 for a contravention date 27/06/13. I am the registered keeper but was not driving the car. My wife had been out shopping in a retail park and apparently over stayed the 2 hour limit by 33 minutes. The resulting charge of £60 seemed excessive considering she was a customer and unaware of the limit of 2 hours.

However, my dilemma is that I have received my second letter dated 20/2/2014 telling me court action is pending unless I payed £166. If payment has not been recieved proceedings will be initiated in the county court where a judgement may be obtained.

I am worried that I will need to go to court and have no experience to defend myself.

Any advice would be really appreciated.

    Your situation is no different from anyone else with a dodgy PPC ticket. Specifics are not an issue.

    read the thread that was linked to and believe it or not there have been many threads of a similar nature
  • Which PPC is this please first - may not be a wise move if keeper liability cannot be pursued in any case?

    Probably not realising that:

    - the forum has a search facility above the threads on page one of the parking forum, next to 'forum tools'. The heading is: 'Search this forum' pop in 'Newlyn', change the default to 'SHOW POSTS'. Read zillions of other Newlyn threads till the cows come home.

    - on a forum the first thing to do is read the sticky threads at the top. On this forum, I wrote a 'NEWBIES' FAQs thread which covers all situations re a fake PCN.

    - There's another forum 'sticky' thread I wrote, all about complaining to Retail parks to get these fake PCNs cancelled. Again, at the top of the forum!

    Newlyn are not taking you to Court. Please don't do random Google searches about NEWLYN which will include irrelevant stuff about bailiffs (they are NOT bailiffs in the case of a PPC fake PCN).

    Seems like a plan if it was a postal PCN - which the OP will read about when he reads the NEWBIES sticky thread, about rewinding the clock if 'too late to appeal'.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
