Yes your case would be strengthened as keeper. Some PPCs never send anything but I think Meteor will. You'd win at POPLA but don't be surprised if they send a debt collector letter first - in which case you'd need to complain to the BPA - of course, as keeper, WITHOUT mentioning the windscreen ticket or driver or the parking event.PRIVATE 'PCN'? Parking on railway land is always subject to railway byelaws, regardless of whether enforcement takes place under those byelaws.
Meteor/ Southeastern don't bring byelaw 14 prosecutions, despite threatening to do so, and despite pretending that their invoices are valid byelaw 14 tickets, so there is no need to worry there.
Therefore, there is an additional appeal point that the land in question is not "relevant land" within the meaning of Schedule 4. Furthermore, add that Meteor can only claim against the driver, not against the RK, that Meteor's "notice to keeper" is incorrect in law in claiming RK liability, and that Meteor have provided no evidence that the RK was the driver (which is neither admitted nor denied).
In practice, however, a reference to GPEOL should see a easy POPLA win, without POPLA even needing to consider the point of RK liability.0 -

Hi,
We have now received the same letter to keeper as louloukoi16 from the 'PCN debt recovery and prosecution service' and the original ticket from meteor shown on her thread is again the same as the one on the car originally with a different reason quoted.
It is dated 19th May for parking on 12th March mentioning byelaws with no mention on popla and no where to appeal to. I have been unable to check the signage as it is a 2 hour drive from our home.
I am utterly confused by the situation and cannot quite understand from her thread the process I should follow.
Who do I write to and which is the best template letter to follow?
Do I add a sentence regarding the parking being paid for and the driver finding the 'permit only before 09:30' unclear.?

Also, did the original PCN mention POFA 2012? If it did then it was mis-issued (the DVLA's term) and falls within a similar complaint as successfully pursued by prjohnsonnn against MET at railway stations. I am very sorry but I am still finding the info on the other post very hard to follow. Please can you clarify the best steps to take?
Do I write to meteor, bpa and the train operator and dispute the way in which the issue has been handled, that a windscreen ticket mentioning popla and not byelaws followed by a letter referring to it as a byelaws ticket without an option to appeal is unfair?
Do I send the template appeal letter to meteor to appeal and try and go down the popla route?
Do I write to the debt recovery people and notify them that the charge is in dispute?
I am happy to admit that an error was made choosing a bay and pay a fair charge but £45, now £90 seems excessive.
I sent a PM to the other poster asking how she was handling the situation yesterday afternoon but have yet to receive a reply.

There are two or three other recent posters and none of you have breached the 'byelaw 14' offence of failing to pay. Your best bet to get your head around this is to discuss it with the others in the same boat. I would search the forum for 'Meteor' as a keyword, to find the other posters and pm them too.
The others have said the PCNs don't mention POFA 2012 so forget that. Concentrate on the fact that these letters wholly mislead you as they say the PCN is issued under byelaws when it isn't. And just because it's a railway car park, Meteor are side-stepping POPLA which is unfair and in breach of their BPA code of practice and arguably in breach their registration with the DVLA to obtain data. A private PCN in a railway car park should be the same as any other, with POPLA offered (except only the driver can be liable).
It is a bit counter-productive for us regulars here, to be replying on 3 or 4 threads every other day all with the same issue. I have found myself repeating myself on all the Metoer threads this week and in fact you all need to seize the chance to complain in numbers! You should get together with the others you find when you search. This complaint will take time and I suggest you all discuss the issues by pm and decide your joint way forward. You can't send the template really as POPLA is not offered - that's one of the many misleading issues! And no-one tells you to write to the worthless debt collector, that's pointless.
