looks like we are going to have to stump up just over £100 to get our sale over one last hurdle.
The solicitor says there is a bit of paperwork missing covering the ownership of an alleyway and that to get things moving we need to pay for indemnity insurance. We don't have an option but to do this as we are on a very tight timescale to move house but it is rather frustrating having to pay more money out when it is such a minor issue.
The missing paper work is untraceable as it was from a firm of solicitors no longer trading and to do with the sale many years ago!
Anyone else had to pay this insurance?

Questions about indemnity insurance come up daily on this part of the forum. If there's paperwork missing then indemnifying your buyers is the only sensible thing to do if you want this, or any other sale of your property to go through. In the great scheme of things a hundred quid is neither here nor there. Much better than your buyers coming back in a few year's time and trying to sue you for tens of thousands!0

As a necessary bit of paperwork is missing it's not possible to know what risk the buyers could be exposing themselves to, so they could try to sue you for almost anything at all. Hence your insurance0

They could sue you when it turns out they don't have rights to use the alleyway. After 12 years of using it, it would be accepted in law that it's a right, but if it's not on the Deeds, and there's no agreement on paper, so who is to know for sure.0

I feel for you!
I had to shell out £100+ to cover the absence of planning permission on something that didn't require planning permission and to cover the possible breach of an old, long forgotten covenant. :mad:
Just got to suck it up really or delay the transaction while you argue about it.0 -
Just had to do the same (bit of a bummer) but as others have rightfully said you may as well get it paid and move on , if you were not moving you could probably sort it owt for nowt with a bit of time on your side but it has only come to light because you are moving and it's holding up the sale etc etc0

For all the buyers know, the paper may say that the property owner is responsible for cleaning the alleyway once per week. And the cost of maintaining the tarmac.
It might say the alley is part-ownerd by someone else, who has rights to build a roof over it (unlikely - but you get my drift) blocking out all light to the property windows.
It could say anything.
The buyers would be mad o buy without knowing. Hence they want indemnifying against..... whatever the paper says.0 -

First time doing this house moving thing I see why its said to be so stressful now forever been chasing estate agent and solicitors!!

I have recently had a bay window put in where there was a flat window with a large canopy over it. I was told by the council I didn't need Blg regs as I was only filling in the existing area and not going beyond the line. I had the windows made by a reputable Company and my builder FItted them.Someone has now told me if I sell in the future I will need a certificate for the PVC windows. The window manufacturer said he is not Fensa registered, so Do I have to get Indemnity Ins.o0
