    If they issued a ticket affixed to the vehicle then no, but if there was no ticket affixed to the vehicle then naming the driver can reset the clock.

    Have you managed to get the proof of delivery from the Royal Mail website?
  • I did download the information from Royal Mail's website.

    I sent the letter on 22Mar14 and it was signed for on 26Mar14 (the deadline was 25Mar14)! Unbelieveable! It is as you said ... these parking companies are sneaky.

    Regarding the PCN, the first I learned of it was via the NtK. I reviewed their evidence online and noticed that they apparently did affix a ticket to the windscreen, but this was never received as the night in question for the PCN was during a rainstorm (I assume it had washed away).

    I was not the driver, so was wondering if I could name the driver at this point?

    If not, what do you suggest?

    Great offer OP, go with it.

    By the way, there is NO statutory time limit to appeal to the PPC, nor is there any time limit prescribed by the BPA.

    You can name the driver (with serviceable address) at any time up until the commencement of legal proceedings by the PPC (issuance of Court papers, not a LBC).
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    "Thank you for your correspondence regarding the above Parking Charge Notice (PCN).

    We have considered your case carefully and have accepted your appeal to cancel the PCN. No further action is required from you in respect of the PCN.

    Please not that all appeals are considered on their individual merits and future appeals may not result in the cancellation of the PCN.
    "

    That boiled down to a letter saying "Recorded delivery appeal deemed served on 27th day. POPLA code or accept the appeal, or we treat this as criminal harrassment."

    So sometimes a strong stand against the PPC works.
