I want to help my mum try to reclaim the charges that that she has with a credit card from MBNA as the debt would have been repaid years ago if it weren't for the charges being added & the interest not being freezed when she was told it had been... (could go on for hours about that )
Has anyone reclaimed charges from a credit card? is there anything different you should do? The credit card was with the royal bank of scotland, should I be sending letters to them or MBNA?
The only part that worries me about doing this is that MBNA have now/are trying to put a claim on the house so as if it's ever sold they will get 'their' money, is this something I should be worried about?
I've download the first templete letter & started to get that ready for sending off so any help would be great!!!:o

Yes, you can reclaim credit card late payment charges.
Even the Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of administering a late payment or going over your limit and therefore unlawful. All that happens is that the computer adds the charge to your account. You don’t usually even get a standard letter.<O:p</O:p
You can use the letter templates for bank charges with a little bit of customisation. Send them to the Royal Bank of Scotland.
Unfortunately, the Financial Ombudsman will only request that the company involved pays the difference between the current £12 charge and any older and higher charges, so is not an alternative to court proceedings for these claims.
However, RBS do seem to be currently paying out after 6 - 7 weeks. The acquisition of wealth is no longer the driving force in my life.
