Hello,
I've been issued a parking ticket/fine from Parking Eye for parking in a retail park carpark on Saturday 1st March from 9pm to 2am at night. Of course the fine is down to overstaying the 3 hour limit. I understand the point of this 3 hour limit is to help with traffic and maintain a steady flow of cars so customers can attend the several shops at a retail park however in this case I parked my car in the middle of the night as none of the stores were open.
There were several vehicles at this carpark who're still there from when I parked to when I left so in this case I wasn't the only one in this mindset.
I believe I should be able to argue my case as I don't believe a £54 fine is a fair amount to pay when I wasn't in any way a hazard, obstacle or nuisance.
What do you think? Do I stand a chance here or should I just pay up?

I know it must be a pain to come across these sort-of threads but I have read the newbies guide and still find myself ill in confidence on whether I stand-up for a viable defense or not.
What I'm saying is do I sound stupid if I simply state I parked in the carpark outside of the retail hours so I don't understand why I should be enforced to pay money to a private parking company?0 -
It is nothing to do with circumstances and everything to do with the law. You need to re-read the Newbies thread with a pad of paper and pen at the ready to take notes for the parts that match your situation.

You certainly wont get the charge cancelled if you just write that as a reason.

If you've read the NEWBIES thread then you'll have seen the appeal letter to send to Parking Eye. Nothing for you to do except copy and paste.0

As already stated it is NOT A FINE - however I am intrigued by the amount of £54 unusual for a parking eye site.
Should you pay up? - well it is your money - but what a silly question coming on to this moneysaving expert site - If you want to waste money - I'll send you an invoice to pay.........
Do I think you stand a chance here - absolutely if you follow the good advice given and read up on POPLA appeals - 100% success rate - they are even throwing in the towel when they see a forum aided appeal.
Do come back after no doubt receiving parking eye's template 8 page rejection letter - should contain a POPLA code - this is strictly time sensitive. Come back for advice should they not send one.
Take this time to start researching POPLA appeals in readiness and do not submit an appeal without getting it checked over here first.0
