Excel Parking Fine, Scotland

I got a parking fine of Excel Parking. I have parked in a car park that was normally an 8-17:30 pay and display, so it being 18:30 I parked and left the car, I never noticed any new signs in the car park telling me it was different. Yesterday I received a parking fine from Excel for £60 and I phoned them to explain the situation etc. they told me I'd need to appeal but I said to them I wasn't going to pay the fine. Do I have a leg to stand on or will I need to pay. The pictures on the fine of my car were shocking, you can hardly see the car at all. The fine wasn't on my car, I received it in the post yesterday in almost a poster form

    Ignore them, there is no registered keeper liability in Scotland , you need to read the sticky thread by coupon mad she explains this in more depth. Despite the language used excel does not do court in Scotland

    Just confirm for our peace of mind that either the vehicle is registered in Scotland, or the car park was in Scotland?

    Excel are still nursing the bruises they incurred at a number of courts south of the border and aren't likely to start things off north of it.

    There is much twaddle put about by PPC's about court action in Scotland but the truth of it is that none of them has ever risked it. Yes, we've heard about the case of Daniel Onifade but those proceedings did not involve a PPC despite the claims of some.

    @ Ivorymet1 - put the paperwork in a drawer (never destroy documents that may relate to an unpaid debt), pop the kettle on and make yourself a cup of tea. Then put your feet up and enjoy a pleasant early Spring evening.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    So I've not to appeal or reply in any way? What if they send a debt collector then my credit rating gets ruined? I literally thought it was a joke, the pictures of my car are shocking and it honestly looks like a advertisement poster. Total joke basically.

    No debt collecting agency worth their salt, or at least their professional insurance, will touch a claim north of the border. You won't get anything on your credit rating as that requires a court decision (a CCJ in England, I believe the Scottish version is called something different), and as has been said they will not pursue you in Scotland.

    It's called a Decree in Scotland and goes through the sheriffs court , this won't happen as the liability is with the driver only, they don't know who that is unless you tell them.

    Well I kind of did cause I said I've parked there loads and never had a fine and they told me it's a "recent thing" and told me after half 10 at night it's free but I went down to the car park today and there's no times whatsoever on the signs that tell you times

    So that doesn't matter, anything said over the phone can be denied, you park there at 11pm tonight and wake up and have a ticket, so you phone up and they say nope we didn't say that , now come on prove that they did
