Okay people My Claim was served to Barclays by MCOL on 5th June 2007, they have acknowledged this but nothing further...
They have 28 days from 5th June, which is 3rd July (TOMORROW)!
Do I have to allow them 3rd July then ask for a judgement on 4th or can I go ahead and ask for a default judgement on the 3rd??
Many Thanks people! Fingers Crossed!!:D

hi vicky
no you will have to wait untill the 4th but be warned evem if you do they still have time to enter a defence they are very good at timing it just right i know this to my cost i did the same and they entered a defence on the folowing day ,problem is with mcol its a bit on the slow side so be prepared to go all the way with barclays as i am at the moment they will pay up but not untill ypu have a court date and then they will settle 2 weeks before if not on the day before stick with it and be strong
regards OAS (DAVE) ITS A FAR BETER THING I DO NOW THAN I HAVE EVER DONE BEFORE

I'm in a similar situation. My bank has until the 10th July. The claim was acknowledged on 12th June. Just to confirm if they don't respond by the 10th/11th does this mean i automatically get the money and they won't be able to file a defence if i've already started the judgement? I believe this is the case but just wanted to confirm.0

i am at a similar stage. Barclays filed a defence and then Northampton have transferred it to my local court. i believe the next stage is an allocation questionnaire will come from my local court and then a date will be set. Not sure how long it will take though. Regards.0

Money Claim Online should have issued your claim either on the same day, or the day after, you filed it. They then allow 5 days for it to be served. The bank’s solicitors then have 14 days to respond. However, their response can be just filing an Acknowledgement of Service. If they do this, the 14 days is increased to 28 days. If the deadline expires on a weekend or Bank Holiday, they get the Monday or Tuesday respectively.<O:p</O:pThe acquisition of wealth is no longer the driving force in my life.
