Will building insurance pay out for chimney

My chimney stack is starting to bulge out at the side and the chimney pot is starting to lean a little bit. It all gets worse every time its really windy, with rubble falling down the chimney etc.
Would the building insurance pay out to fix this or will they just turn round and say it's maintenance?

Maintenance. If you don't take remedial action to keep it in good repair your insurance may well be invalidated in the event of a claim.0
