non- compliant signage

Options
I can't seem to add the photo from my phone, there are no signs at all on the entrance to the disabled car park which is a separate entrance from the main car park. There are two small signs in the disabled car park which are too small to read. Does this make it non- compliant to BPA?
I haven't had my letter back from tps yet but when it comes should I include the photo with the popla appeal?
Thank you in anticipation

Assuming that you have read the sticky thread at the top of the forum. If you have already appealed to TPS then you could challenge the signage to POPLA when TPS reject your appeal. Obviously also include all of the usual appeal points (Genuine pre-estimate of loss, no contract etc). Photos may help, but if you raise non-compliant signage then it places the burden on TPS to prove the signage is compliant.

I would say that photo's will help the BPA if you decide to complain that their signage isn't compliant with the BPA code. It is always worth complaining, just make sure you don't identify yourself as the driver in any correspondence to the BPA.

Hope you are in England or Wales.

Did you wait until the NtK arrived before appealing.

Non-compliant signage will be included in any POPLA wording as part of the appeal. The BPA's COP did not consider the Equality Act when their "rules" were devised - conveniently twisting wording to permit the PPCs to issue PCNS. The Blue badge scheme does not apply on private land and no private employee has the right to inspect their validity.

The OP's first priority is to win at POPLA - so will not be contacting the BPA regarding any signage until after winning his appeal

Which is why I said IF, also it is up to the OP, if they feel able to manage the POPLA appeal as well as the BPA then why shouldn't they.

Also, the OP has already appealed to the PPC as they are waiting their reply so that they can appeal to POPLA.

As far as signage is concerned if it has been in place for some time the BPA, having set down the requirements, then thoughtfully granted its members a dispensation meaning that their signage does not have to be compliant until 2015. If the signage has been installed recently then that dispensation almost certainly doesn't apply.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Don't forget that signage alone isn't the only POPLA point to rely upon. And the fact that a lack of signs 'breaches the BPA CoP' is less important than the fact that no signage means there is no contract formed with the driver. POPLA will listen to an argument about the latter.

See 'How to win at POPLA' when you get the POPLA code (it's a link in post #3 in the 'Private Parking ticket - Old or new? NEWBIES please read these FAQs first' thread). You need 'no GPEOL' and 'no contract/standing' as well.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
