Can anyone advise please .My son and his wife both work but last April they had a baby so only my son worked although my daughter in law got maternity pay for the entitled time . They applied for help through the system told no as it was based on last year but a little while ago she realised through a friend she had filled the form out wrong I'm not sure when . She has now returned part time to work with baby in Nursery as she chooses to work .After ringing the Benefits office they do get some .She explained to the person about the mistake in filling in the form and was told there may be a payment backdated they were so happy as they really struggle .they got £1.28 paid into their bank plus a letter . On ringing to ask if it was a joke she was told only Asylum seekers and Disabled people are eligible for backdated payments but apparently they have a pot which holds funds and if on sending in their P60s if they are telling the truth about salaries they may get something . I have told them to appeal but where and who to . Can anyone tell me if this is right

Thank you

Is it WTC and CTC they're apply for, and was it in this financial year Apr 2013- March 2014?

I know a lot of benefits have a backdating limit of 3 months max. You don't say what the benefits your family are applying for, but perhaps if you did, somebody could give you more constructive advice.
The bigger the bargain, the better I feel.

I should mention that there's only one of me, don't confuse me with others of the same name.

Yes they applied a while ago but turned down due to earnings before baby born which was 2013 April now applied again and has been told
What I have said above . Think it's only WTC applied for I'm not really up on the system just seems so unfair .

Thank you for that not knowing the system I don't know without asking them but I think they applied got turned down so didn't do anything until last month on her return to work I know she had to start work before claiming as she had to pay a months child are up front which wasn't good .They have to send p60s in as I say is this to
Do what you say about holding money back .

You cannot be turned down for WTC due to income. You would still be given an award even if income too high. It would show nil but it would mean after the year ended they would get renewal forms to fill in and declare their actual income.

If they got a letter turning them down it will be because they were not entitled for some other reason. How old are they both?

    Thanks both

Just spoke to them they say they could not have WTC due to salaries
and when she was going back to work was told she had to start before
Claim as for P60 they said they don't have to but will prove earnings .Sorry for any confusion I really don't understand the system I think she got so much for maternity pay from work for as many months as mums get it and then my sons wages .Baby was born last week of
April and she returned to work a couple of weeks ago . Baby goes to Nursery 3 days a week which is not cheap and they had to pay in advance . Thank you for your help and advice . I know this might sound like a stupid question but is the amount they are getting at the minute limited until the new tax year if so and they are entitled to more will they backdate the difference . Do you think that's what they meant at the benefits office about the pot !

I don't really think we can help you without fully understanding what happened as what you say doesn't make any sense.

Did they actually submit a WTC claim form or did they just ring the helpline and were told their income was too high to claim? I can understand if it was the second one, but if they actually made a claim it would not be refused for income being too high, that isn't how tax credits work.

Can you tell us the age of them both?

I am going to ring them and get things straight lol . She said they filled form in at some point and got told income to high for the qualifying period . My son is 35 daughter in law 28 I think . As I said before returning to work she was talking to a friend and was told she had filled a bit of the form in wrong something to do with Maternity
Payments that's why when she rang to say circumstances had changed and was returning to work she mentioned the mistake in filling form in .

Ok, the main thing to find out is:

    1. Did they fill in a claim form?
    2. If they did, what did they get back? At letter saying they were not entitled or an award notice that showed nil
    3. When did they send the claim in?
    4. Did they receive any other forms?
