housing benifit

I rent my house from my sister in law and her partner, but now my husband has gone part time at work we decided to claim housing benefit ,but housing want her to fill in a questionnaire which she is refusing to fill in as she finds it private and personal ,so now housing are refusing to give us housing benefit, where do I stand with this ,should I dispute it with housing. thanks:mad:

    Councils are wary of anyone renting from relatives and claiming HB.

    Therefore, they always need a lot of information to do their checks, and, so, I can't see any way out of this, unless your SIL fills in the forms they require.

    They have their rules and stick to them.

    Does your SIL have a BTL mortgage, landlords insurance, pay tax on the rent you currently pay?

    Even if she does have everything correctly in place she may well find that her mortgage will prohibit her renting to anyone in receipt of housing benefit

    The other test is around contrived tenancy, have you always paid the rent amount? (would the rent be lower when you pay yourself and higher when HB is involved) would she evict you if you are unable to pay rent?

    Was it his choice to go part time
    make the most of it, we are only here for the weekend.
    and we will never, ever return.
  • This is pretty standard when renting from relatives to ensure that the tenancy is on a commercial basis and isn't contrived to take advantage of the Housing Benefit system.

    Your Sister-in-Law doesn't have to complete the form or answer any questions and you won't be paid any Housing Benefit. So as long as you are happy to pay your rent from your own resources and if you can't your Sister-in-Law is happy for you to build up rent arrears and put you in financial hardship then she shouldn't bother to complete the form.

    However it is in her interest to complete the form, ensure you get you Housing Benefit money so she can pay her mortgage.

    If she has nothing to hide I can't see what her problem is after all completing the questionnaire she will ensure you get what you are entitled to and ensure her tenants have the finances t pay their rent and she can pay her mortgage.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
