Return of Deposit

Hi All,

Just looking for some advice regarding getting my deposit back.

In my contract it states that 'The landlord or Landlords agent must tell the tenant within 10 working days of the end of the tenancy if they propose to make any deductions from the deposit'.

Does this mean that after 10 days he can no longer deduct anything from the deposit and has to give it me back in full?

I moved out on 19th February and have heard nothing from him since. Can I just raise a dispute with TDS to get the deposit back? Would the TDS now side with me if he decided to put in a deduction from the deposit now?

I am a bit worried that he will show people round the property and get it all dirty and blame me for it and ask to get it cleaned.

    You should claim the deposit. The LL can still deduct for any damages they can prove, but delay in conducting checkout inventory does make it more difficult for them to claim for items such as cleanliness which can deteriorate with time.
  • I always claim the deposit back the day I move out.

    The clause merely reflects the process of the deposit schemes.

    If you have not either received your deposit back within 10 days, or reached agreement on any deducions, then raise a dispute with the scheme.
