Tenant who has been bankrupt - should I consider it?

  • Ask for 3 months bank statements from their main account and make sure its being run properly, if you see the accounts in debt or there are lots of strange transactions (ie betting companies) then it should red flag it for you.

    If they are good and honest this won't be a problem.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    I'd do this too and also maybe ask them to let you see their credit reports. If there are recent issues, they'll be flagged and you'll have a better idea on if they can pay the rent.

    Landlord references from any sensible landlord say nothing worth hearing as you can easily get sued for a bad reference. Highly unlikely therefore you'll ever see a 'bad' reference and often landlords have no interest in giving a reference, it gains them nothing but possible aggravation.

    If I for arguments gave you a reference for Mr Smith saying "Great guy, always paid and I wish he'd marry my daughter.." then Mr Smith didn't pay and smashed the joint up - who is going to be getting your solicitors letter? Me.

    Plus if you like the person, just forget all the 'social morality' stuff and take them on, trust your instincts.

    If more people trusted their instincts there'd be a lot less posting on this board.

    Like with employment references you can provide a bad reference if it is factually true. Ie tenant X missed payments 3 months out of 5 is a bad reference but if proven is factually true

    You will find that no major company will give an employment reference further than "he worked here".

    You can provide a bad reference if you like. But personally I would steer well clear, you might just end up being; believe that.

    Ultimately it is actually your word against theirs so for instance you supply I reference for me saying "Dorsetty has missed 3 payments out of 5"

    So, I have a legal right to see that reference and then I tell my solicitor, "That's not fair, Takeaway made me pay him cash in hand 3 months or he said he'd chuck me out"

    Now, you prove you didn't. :) Or maybe you like the HMRC having a cosy chat with you? They are happy to not believe your returns, they are desperate for cash

    You see, your idea is all well and good on here, but it is not reality. You come up against a switched on bunny and you'll create a problem you really do not want.

    So my advice is, if people ask for a reference, just say 'No'.

    No it is not 'scaremongering' it is the difference between middle England, the land of the Daily Mail reader and the life that so many lead now.

    I'm very fortunate, I haven't led a sheltered life where so many it seems have. Myself I went to a private school but I have also lived on a S London sink estate (Known as 'The Zoo') and I'm proud of it. That's just this country of course, let alone what I did when wandering the world.

    Now, if someone is prepared to stiff you over the rent or smash the house up they are more than capable of lying to drop you into a world that you do not want to be in.

    I've seen it happen and frankly I just had to laugh. People especially in the UK it always seems, think every thing should be 'right and proper' and people shouldn't take advantage or tell copious lies.

    This same chattering class also think they are somehow 'entitled' because they have a job and a mortgage so this allows them to look down on those 'Others' (a Sociological term). Why? Because these middle Englanders would have it they are hard workers whilst the 'Others' are clearly not in their view.

    If middle England doesn't like 'them' I can assure you they hate middle England and will do anything in their power to get at those people.

    You know if I have say a Smith & Wesson Bodyguard . 38 Snub Nose Special revolver and I put one round in a chamber, I have a 1 in 6 chance of blowing my head off should I choose to pull the trigger. They're still not odds I'd be taking, personally.

    On the same basis, why would anyone in this highly litigious society risk a nasty problem just because they think are entitled to tell someone, that someone else, in their opinion, is not 'right and proper'.

    Common sense thrown out for 'entitlement', it seems to me.
