If you are talking about £250K and disputes between insurance companies, I think you need to take legal advice, you can't get sensible advice on a forum like this where people aren't qualified and can't see the original documents.0

yep, legal advice might be need and the rights and obligations for you and the other party in your contract might come into play.
The general principle is that liability flows from negligence so, assuming you weren't aware that the land was unstable you should be ok.
Also assuming it is not causing an active danger I'd be inclined to sit back and await developments before spending money on lawyers0
