Non-compliance with BPA code of practice appeals procedure

Where does this un-numbered point fit in that in between your numbers 2 and 3?

Point out to these scumbags that the DVLA and BPA sent an email to all AOS members in January to remind them:

"The following practices may be considered as Code breaches and must not be continued:
Asking the motorist to enter into additional correspondence to obtain a POPLA code
    • Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
    • Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied
    "

Ask them what part of that did they not understand? And that you will report them unless they reply by return within 7 days with a POPLA code or cancellation.
I received exactly the same letter from vcs.I wrote back with the above info only to receive a letter telling me that I should hear from them within 35 days. So thats a total of 70 days plus the time I waited to receive ntk . They certainly like to string the process out and they ignored my request to supply POPLA code by return of post.I have reported them to the BPA, they have issued a complaint number. I chased them up yesterday only to be told that they were still investigating.

If you don't know about the signage then you could put it in anyway. There are templates in the Newbies thread which cover signage. The point is that it makes them spend time proving their signage is compliant.

But the main winning point is GPEOL, so the appeal should be good as is.

But you should indeed still put 'unclear signage' and expand upon it in a POPLA appeal. Where in any advice here do we say you have to go back and check the signage? Answer = we don't, because you don't have to - it's up to them to rebut any points you make and you should include 'unclear signage' paragraph as you can see in the usual examples of POPLA appeals on various threads.
