Deceased Estates

Maybe a bit morbid but just general nosiness really I wonder if anyone can enlighten me on the following legal notice which has appeared in local paper

Background - Sadly our neighbour passed away after illness on 11 June aged 59 single man twice married no kids, survived by sister & mother. Funeral 19th June, house put up for sale 27th June.

This Thursday legal notice appeared in the paper

Re Mr Joe Bloggs

Pursuant to the Trustee Act 1925 (Section 27 Notice)

All persons having claims against or an interest in the estate of the late Mr Joe Bloggs of 59 Bash Street , Windsor who died on 11 June 2007 are required to send written particulars to the undersigned on or before 31 Aug 2007, after which date the Executors will distribute the deceaseds estate having regard only to the claims of which they shall then have had notice.

Dated this 22nd day of June 2007

This all seems very fast to me I'm just wondering if this meant there were a load of debts incurred and people have to get their claims in ? When my Dad died 18 months ago I (foolishly in hindsight) passed it all over to my Solicitor to do all the probate stuff which took them forever and generated a nice fat fee but I don't recall any legal notices like this.

    I believe it's a notice served by the Executor(s) to protect themselves against any potential claims being lodged against the Deceased's Estate once Probate has been granted, when the Estate has been distributed.
    Otherwise someone could come out of the woodwork when the Estate has been distributed according to the Will - and the Executor(s) finding themselves in some way liable for that claim.

    Interesting but I'm not sure though cos if this was the case surely local paper would have quite a lot of these ad's ie everyone who died leaving a will. The paper this one was in only had one other in respect of someone who died 9 months ago - as I said this death was 11 June

    The executors don't HAVE to advertise - if they are pretty sure they know all the debts they won't bother. And if they themselves are the sole beneficiaries there's no point - if they advertise they will not be responsible as executors, but they will be as beneficiaries, so they may as well save the expense.

    It is odd for it to appear so soon after death though.
  • old gent i knew died few years ago had sev relatives close by but sev others he lost contact with over years lived away he died leaving large(ish) amount of money and his house but he never made a will so solicitors put notice in paper similar to one in op so they were sure they had got details of all family before they divided his estate up there are usually 2 or 3 a week in our local papers
    Lead us not into temptation...

    just tell us where it is and we'll find it....
