Thank you for all your responses, much appreciated. I can understand where everyone is coming from with regards to their responses. Emotions a side, I still think the manager was in the wrong for attempting to discipline me infront of both customers and colleagues, so I feel just in my grievance (also, I think the grievance issue has been building up a while now due to other things aswell). With regard to me walking off shift, that is my fault and I should have some sort of discplinary regarding that, however, surely their is a degree of responsibilty with the manager as to their position with me, thus should have contacted me. I think what Luvly.cuppa.T has said is spot on with the emotional side of things, because I can honestly say I have worked really hard for this company, sacrficed alot of family time when they have been short staffed etc and dont really feel that they have done much in return. Thanks again to everyone and I will keep you posted with regards to the outcome, I am now waitng for the area manager to investigate the matter and contact me.

Sorry to barge in on this query but I am at my wits end and I didn't know how to post my query! My son is a website developer and left his job of £20,000 to go self employed 2 months ago. I came back off hols early this morning to find that his previous employer is doing him for breach of contract as he is doing work for one of his pre employers clients! He never signed a contract and was unaware of anything to say he couldn't take work for 6 months off his old employer. He did not actively seek work from his client but was approached by another contact to see if he would do work for them. CAN ANYBODY OUT THERE HELP AS i AM NOW EXTREMELY STRESSED!!!!0

Did he sign anything at all? Did he receive his contract of employment, even if he did not sign and return it? Did the employer have any kind of written and signed discussion with your son?
If the employer is threatening to take him to court for breach of contract, the ex-employer will have to show the copy of the contract or similar in writing. Probably the ex-employer is just jumping up and down shouting angrily and making loud threatening noises but will actually be unable to do anything about it, if what your son has said is correct, because he won't have the contract!
However it's poor practice to do this - these kind of circles tend to be small and your son doesn't want to get a bad reputation in the marketplace. It's best avoided if possible, I think, before a reasonable amount of time has elapsed.0 -
can anyone help on this one then??? ive been with my employer for 15 weeks and had no problems. Then this young inexperienced lad turns up (and not wanting to sound horrible) he hasnt got a lot going for him and people are taking a dislike to him, he keeps messing up, wont listen and keeps reporting people for minor incidents.
So, friday comes and i get called into a informal meeting with my boss and am told this lad has told my boss i left 40 mins early the wed previous, and whats more i allegedly asked him to cover for me if anyone asks!!!
what i said was "im going to get off early, ill tell the boss on the way out (which is common practice we just bank the hours) he said what shall i say if im asked, i said keep out of it, ill sort it out, you dont need to tell him anything..... he said oh right, so then i said you can cover in here cant you? he said yes.
and off i went... now they have given me compassionate leave while they conduct an investigation! OMG... this lad is renowned for messing up and grassing on others etc... but what can i do. now my bosses are saying ive tried to coerce a colleague into lying to them for me and thats a sackable offence!
AND Then i speak to a colleague of mine who says did you know the office has sent you to coventry? i said well i did wonder why they were ignoring me and not including me, but i wasnt too bothered. why whats been said.
she tells me that the rest of the office staff have taken a dislike to me because "im too pro active in gaining promotion!"
because when we have finished our work i wander off to help others, when they are saying why do that when we can sit playing cards and get paid for it.
so IF i get sacked on wednesday, have they followed proceedure?
1 they didnt give me written notice to attend the meeting, they phoned me half an hour before saying come to this meeting and bring a representative.
2 i now feel i am being victimised and harrassed by other colleagues but as i have under a year employment with them my hands are tied...
3 if i am not sacked i dont think i can put in a greivance for victimisation and harrassment can I?
4 i cant claim unfair constructive dismissal either can i?
5 can i appeal?
6 if they decide to terminate my contract (which is casual) how will it look for me next job?
7 if they thought i was wrong wouldnt they of sacked me there and then?
is it better to go well prepared to the meeting or allow them to take the lead and just cow tow to them?
any help???

Yes, if that was just to tell you that you were being suspended on full pay while the allegations are investigated.

5 can i appeal? Yes and if they find against you they need to give you details of how to do so.

When did you tell them? What is custom and practice re this. Why did Young Squirt not challenge you there and then if he felt you were asking him to lie for him, if he really believed that? And in fact, you might want to put your grievance in and ask to have it investigated - if you think that Young Squirt is trying to dob you in it deliberately because you are unpopular in the office.

thanks for that info, was useful.... phew, dont panic... nightmare... ive now been told by a trusted colleague that young squirt is telling everyone in any department who will listen that ive been sacked because he grassed me up for leaving early. Apparently hes swaggering around and smirking, luckily for me this colleague has reported it to the manager and says they think its unfair as i havent had my hearing yet.
Bosses say he can tell who he wants what he wants as my hearing wont listen to hearsay... my argument is the people he is telling his version to are going to be interviewed, so they may be swayed but his version!!!

will be getting called in tomorrow, got union rep coming with me, so fingers crossed!

now they told me the hearing can take place until monday as the investigator is not available. I think they should either make a decision or drop the case! what does anyone else think?

#Hang on in there until Monday- there is no sign in it, just illness, or something else preventing them from coming in to invesitgate. That's all.
Best of luck with it. (PS also gives you a bit more time to get organised if you aren't already- think of it that way. Also if you are on paid suspension then you will have more money in your pocket for the pleaseure of not working for them!)0 -
ok apparently i am to see my union guy at 12:30 hrs monday and be interviewed at 13:00 hrs..... Union guy is hoping they will say no case to answer and dismiss it...
My mate has seen young twerp today and he said he just put his head down and walked passed....
