Santander PPI Claim Rejected by Ombudsman

    I wrote to Santander last September concerning 2 store cards my wife had in the 90s which had PPI added to them without her asking for it . They replied that my wife was contacted by phone and she asked for PPI to be added , I asked for this taped conversation , they never gave it to us , the second card they said she ticked the box asking for PPI to be added to the account . Again I asked for a copy of this contract , they replied due to the time they did not have it . I then gave it to a company who claims back PPI and they met with the same response . I started county court proceedings against Santander to claim the money back . The claim is still going on if any body is interested in more details let me know and I will give you more information .

    That is interesting. As PPi is not a legal issue and the onus is on you to prove a breach of law, very few take this route and most that have end in rejection and facing costs. One assumes you have used the FOS as well (as that is the next stage after rejection rather than court) and you got rejected there. Whilst the court could overrule the FOS, it would consider the decision of the independent ombudsman in its findings.

    And store cards wouldn't have been regulated prior to 2005.

    What you should have done was acept the initial rejection, then find out who the insurer was [ usually GE Money/Genworth] and then complain to them.
    They have accepted l;iability in some cases where a direct relationship betwene the card sale and the insurer could be found, and paid out.
    They did in my case.

    By all means provide more information about the cost (so far) to you. No doubt your experience will serve as a warning to others not to go down this very costly route.
