Advice for a friend

I have a friend, who like me, lost her husband about three years ago.
She is 72, and up to now has lived alone in her house, on which she and her OH took out an equity release mortgage when they moved in 2005. I think the e/r was about £40k, but she's never made any payments on it, interest or capital.

At the moment, she receives DWP pension (in her own right) and some pension credit. Because of the pension credit she is exempt from council tax.

The situation looks likely to change - for not too long, hopefully - but this lady's daughter is moving back to the UK from an abusive marriage and proposes staying with her mother until she can buy a property over here. She will be transferring her employment from a European company to its UK counterepart, so will not be needing any financial support from her mum - just a home for the time being.

Friend knows that she has to let DWP and local council know that there will be someone else living in her property as well as herself and worries that after her daughter leaves she will have difficulty in reclaiming pension credit/council tax. Her daughter has told that of course she will reimburse her for any money she loses whilst daughter is living with her plus her living costs, but friend is still worried. Can I reassure her that she will be able to reclaim without any problems - any link to any website would help.

It might only be for a few weeks in any case!

    sje wont loswe any pension credit as her daughter is a non dependant and not a partner.
    there will be a non dependant deduction made to her council tax support but there should be no issue re instating full benefit once her daughter moves out
  • As she is a pensiner receivng Pension Credit there will be no non-dep deduction from her Council Tax Support for 26 weeks. Pensioners are protected for 26 weeks unlike working age claimants who would immediately have a non dependent deduction taken.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    Am I reading you correctly - that her pension credit won't change if her daughter moves in and out within 6 months? Is this correct?

    From her Council Tax Support - no change whatsoever from her Pension Credit.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
