I think I understand your position and am quite sympathetic. However, in order for you to "have you day in court" so to speak, there is a long process and one that requires you to complete and prepare a considerable amount of paperwork. Then, even if you complete that stage there is still the lottery of what happens on the day. Why not complete a far less onerous amount of paperwork and be virtually guaranteed that the problem goes away.
As far as the court is concerned every party to an action must be able to demonstrate that they have acted reasonably in settling the action before resorting to court itself. Your position, as it stands, will not help at court. I really do urge you to do as Coupon-Mad has suggested. That said it is your choice and no one can oblige you to do something that goes against your beliefs. Collectively, we have been down this road on numerous occasions and are just anxious to see that no one comes off worse if there is an opportunity to get through it reasonably unscathed.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
