Solicitors Fees

Hello,
Not really sure where to put this, apologies if it is in the wrong area.
Me and my husband separated over 2 years ago. We have been back and forward to solicitors but have got no where with them to be honest in regards to a seperation agreement. My solicitor kept pressing for more from my husband when I didnt want anything from him. He remains in the marital home as we have joint custody of our 2 children and I am rented accomodation.
Anyway the point is, after 2 years to-ing and fro-ing my husband is now in a position to but my out. I am not wanting any of the money from the house, I want it to go to the kids. My solicitor has now turned round and said that although I was eligible for legal aid when I first went to them I am now liable to pay for solicitor fees as I am going to be getting money from my husband....there is nothing in writing stating this it was purely a verbal agreement between myself and my husband.
As there is nothing in writing is it possible to get round this ie my husband state that the money will be going into an account for the kids and I will no longer be getting any....even though we verbally agreed I would receive a payment?
Can anyone advise where I stand on this at all.

As I understand it if you come into money from using legal aid you need to pay the fees. You are entitled to money from the house, even if you choose not to receive it. I suspect that "deprivation of assets" principles may apply here. The money paid does not go to your solicitor but to the state, to reimburse the fees paid to the solicitor under legal aid.0
