EU and Attendance Allowance

Hi

Any info; welcome.

Can a German national who has lived here for more than 10 years claim AA despite receiving his State pension from Germany or would he have to claim the equivalent(if there is one) in Germany despite being habitually resident in the UK.
Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

    Looking at the eligibility requirements around where you need to live below they'd qualify

    • be in Great Britain when you claim - there are some exceptions, eg members and family members of the Armed Forces
    • have been in the Great Britain for at least 2 of the last 3 years
    • be habitually resident in the UK, Ireland, Isle of Man or the Channel Islands
    • not be subject to immigration control (unless you’re a sponsored immigrant)

    I'm sure there's an issue regarding who pays his state pension, his claim has been made exempt, no reasons yet though.

    Looking up myself is a bit sketchy regarding whose responsible to pay his benefits, it seems the country where you're liable for tax and NI is responsible, which i believe would be Germany due to receiving a taxable benefit from that country.

    But.... Is there a discrimination issue.....

    I might be looking too much into the negatives.

    If Germany funds his pension and healthcare (via an S1 form) then I believe that they are responsible for paying any disability benefits. Certainly that's the way it works for retired Brits living in other EU countries, who can claim AA from the UK.
