Copyright of Photo?

I am preparing an item to post on eBay this weekend.
I have come across a photo of a member of the Royal Family wearing the item. Would it be wrong to include the photo, or a link to the site where it can be viewed?
Don't want to be dragged off to the tower.............

    Very dodgy ground. If the owner of the photo complained to Ebay they would remove the whole listing. Do this too many times and you may well lose your head. Same for the link to the website. If the website owner complained then again the whole listing would be removed.

    Nothing to stop you mentioning the royal wearer in the listing though.

    Although you may get a rejection or not even get a reply, it certainly wouldn't do any harm in contacting the website where the photo is located and asking if they would allow you to use it.

    The photo was published in a national newspaper, and when I checked, also appeared in a few other papers. No photo credit was given - so I would not know who to apply ro.
    I thought if the photo was taken in a public place, no copyright was applicable - I am happy to be corrected on this!

    Stand corrected. Newspapers either pay for them or already own them. They aren't public domain.

    Pic ran in many different newspapers, so was probably covered by a lot of photographers-without a credit attached how can you tell.

    I'd imagine the photographer knew and was paid, they don't always have credits. Each picture in every newspaper is accounted for. If you want to know who owns it, contact any of the newspapers it was in and ask.
    I doubt much would happen to you if you posted it on Ebay but it would be without permission and without permision of the owner. There's loads of pictures on blogs and small websites with pictures that the site owner hasn't got permission for. Mostly what happens if anyone finds out is they ask you to take it down but if they think you're profitting from it they could ask/sue for money.

    You can't put links on Ebay listings.

    Put the photo as the 2nd pic - so it does not appear in searches.

    As far as im concerned - if a pics on the net i can use it.

    Haven't even seen my camera for a year :rotfl::rotfl::rotfl:

    You and loads of other people too - but you're all totally wrong. If you take a picture and put it on your blog, then I copy it and use it anywhere else, you have every right to start jumping up and down about that because I have broken the law.

    Makes no difference if I credit the picture to you. The only way I can legally use it is if you assign the copyright to me, or you give me express permission to use it.

    That's because copyright of a picture belongs to the person who created it, full stop.

    It actually belongs to the owner.
    I work in publishing, and we generally have authors signing over the copyright for their images etc to us.

    But I'm just being pedantic ;)
