  • GingerFurball, this seems to be your industry. Yes not an illegal scam but a scam all the same. I'll just take the matter further (partly out of principle) if I don't hear a response in 30 days.

It's not my industry at all.

For future reference, "I didn't bother reading all the terms and conditions before handing out my debit card details" doesn't mean you've been scammed.

The1loan charge £44.99 for the service which is clearly laid out on their website. If that service wasn't what you wanted or expected, then it is your fault for not paying attention to what you were signing up for.

When you click the big button on the main page that says "apply now", the top of the next page states the following:
    We search hundreds of lenders

The1Loan will search and compare the high street and mainstream lenders as well as hundreds of lending products from credit unions and other specialist providers to find you the perfect loan.

How much more clear do you want them to be?

edit: again, the fees are clearly explained in the terms and conditions, and you have to tick a box stating that you have read them. It states the following:
    5.Fees

We charge a fee up to £44.99 for providing the service of acting as a finance broker. By proceeding with your application you are agreeing to pay our processing fee. We specify the fee as part of our communications with You. If You do not enter into a loan offered by a lender or financier within the 3 months We act for You, We will refund your full administration fee minus £5 as stated in the Consumer Credit Act 1974. Refunds must be requested in writing at customerservices@the1loan.co.uk. to avoid repayments being sent to a wrong address. In the event that your card is declined, we will attempt take payment on that same card as many times as we desire for up to and including 60 days after you made your application. If you wish us to stop trying your card please inform us by post or email.

If you did not read the Ts&Cs properly, then that is your fault.

  • GingerFurball: From the second boxed quote above, we obviously have different views on the definition of 'clear' and 'obvious'. But I'll agree with you that T&Cs should always be read. I'll just wait for my refund (as required by law) or I'll take the matter further.

I have to agree with GingerFurball. Under the tab T&C number 5 states:
    5.Fees
We charge a fee up to £44.99 for providing the service of acting as a finance broker.

It's quite clear I found it easily. If you don't use the service it does seem a refund is given.

To take it further you go via the FOS.

And as you were looking for a loan were you going to be short this month ?

What have you requested in writing from them?

I hope you have requested a CANCELLATION of your application and not a refund. Cancellation (within 14 days) brings a FULL refund, they cannot retain £5.
    6. Cancellation
Under the Financial Services (Distance Marketing) Regulations 2004 you have a right to cancel your application within 14 days of receiving these terms and conditions and receive a refund. If You wish to cancel your application, You must write to us. In this event We will refund your fee within 30 days of the date on which We receive your written request to cancel your application. Any such requests should be made to: The1loan.co.uk, Beechfield House, Winterton Way, Lyme Green Business Park, Macclesfield, Cheshire, SK11 0LP

    Hi Op,

    On the homepage the fee is alluded to as well where it says;

So... I'm guessing that you were looking to take out this loan because you're having problems with your finances? Have you considered looking into other options than borrowing more? The Debt Free Wannabe forum is a good place to start?

Out of curiosity I wonder how often they charge less than £44.99 for their services.

I've always wondered that too... I've seem quotes of "between £29.99 - £89.99" before but the person who has fallen foul is always midway through the scale?

Surely running the customers details through hundreds of PDL sites is all automated?
