BMW - Used car - Peeling Paint!

    Can you help? Looks like I'm having the same problem. I Bought a 2009 5 series from a main dealer beginning of Oct'14 and had quite a lot of issues. It even had a dangerous tyre. They've already repaired some painwork, but now have spotted flaking and they won't repair it free. They said they repaired the last fault under good Will as it was only a few weeks after purchase. Granted it must have had none-BMW repair previously but surely they sold the car as approved and fully warrantied. They say it's a used car, that's my risk and I saved on buying new. That's it is an unbelievable attitude from a BMW main dealer. I am happy to name and shame them. I'm taking the car in tomorrow to show the sales manager but he seems very hard faced and I think it will not go well. I think he is new and wants to make a name for himself. Am I still covered under the Sale of Goods act and my statutory rights?

    If your bumper paint is peeling I suspect that it has been recently poorly touched up. My sons car was repaired through an insurance claim and the corner of the bumper was poorly painted over .Six months later it began peeling and flaking there when it was washed.Thankfully it was redone free of charge.
  • Hi, the area is above the rear door. The problem I have is that it we don't know who repainted it and why. It was done prior to BMW taking it in. They want to quote their warranty, which does say repairs must be by themselves or to BMW standard. My point is that the Sale of Goods Act and my Statutory Rights supercede any warranty and state that, even if second hand goods, they must be fault free or any fault drawn to my attention prior to purchase. In addition it says if a fault manifests itself within 6 months of purchase that it can be taken that the fault was there at point of sale and therefore should be repaired free of charge to a reasonable standard.
  • I had the meeting yesterday with the sales manager. He simply would not have what I was saying. He kept on saying I was talking rubbish and that he was not responsible for other people's work. I explained that as he had taken in the car, checked yet, warrantied it and sold it then it all aspects of that car are now covered by the sale of goods act and I am covered by my statory rights. After some time he went to see the dealer principal. On his return his exacts words were "I came from a different background and my boss sees it differently to me" in other words he knows his facts and agrees with me. He also knows the value if goodwill and the dangers of social media. They have agreed to correct the fault at no cost to me. Let's hope they don't change their mind and we end up in court. Great news, I am happy. Although it should note have taken an argument at BMW with the sales manager. He is new and has a lot to learn.
